Abstract:

Tématem bakalářské práce jsou pracovní úrazy a nemoci z povolání. Práce poskytuje vzhled do České právní úpravy této oblasti, a to nejen skrze právní úpravu de lege lata, ale v závěru obsahuje též návrhy de lege ferenda. V práci je použita především metoda analytická a komparační. Právě díky metodě komparační, prostřednictvím které porovnávám právní úpravu České republiky a sousedního Německa obsahuje práce na vybrané téma zajímavý a nový pohled. Práce je pro přehlednost rozdělena do dvou stěžejních částí obecné a aplikační. Obecná část se zaměřuje na vymezení základního legislativního rámce pracovních úrazů a nemocí z povolání včetně odpovědnosti zaměstnavatele. Pro komplexnost jsou dále zmíněny i jednotlivé druhy náhrad, které přísluší poškozenému zaměstnanci při újmě na zdraví a při újmě na životě. Samostatnou kapitolou v obecné části práce je potom charakteristika oblasti bezpečnosti zdraví o ochrany při práci, též označované jako BOZP. V této kapitole je vymezena definice bezpečnosti a ochrany zdraví při práci a rovněž je specifikována legislativa, která tuto oblast ovlivňuje. Aplikační část práce si klade za cíl objasnit nově vzniklé specifické problémy, které přináší současná pandemická situace onemocnění Covid-19. První problematickou oblastí, kterou v práci zkoumám, je uznávání onemocnění Covid-19 jako nemoci z povolání. Zejména hledám odpovědi na otázky, kdy a za jakých podmínek může být onemocnění Covid-19 nemocí z povolání a jaké profese mají nárok na jeho uznání za nemoc z povolání. Druhou problematickou oblastí, která se do každodenního života zapsala výrazně s příchodem pandemie, bylo omezení osobní přítomnosti zaměstnanců na pracovištích, pokud to nebylo nezbytně nutné. V souvislosti s tímto omezením se tak většina zaměstnavatelů musela uchýlit k výkonu práce z domova, nebo-li tzv. „home office“. Na takový stav ovšem nebyla Česká právní úprava adekvátně připra-vena. V této části se nachází již zmíněná komparace s Německou právní úpravou, která v závěru přináší mé návrhy na změnu české právní úpravy

Abstract:

The topic of the bachelor thesis is accidents at work and occupational diseases. The thesis provides an insight into the Czech legislation in this area, not only through the legislation de lege lata, but in the end also contains proposals de lege ferenda. The thesis uses mainly analytical and comparative method. Thanks to the comparative method, through which I compare the legislation of the Czech Republic and neighboring Germany, the thesis on a selected topic contains an interesting and new perspective. For clarity, the thesis is divided into two main parts - general and application. The general part focuses on defining the basic legislative framework for accidents at work and occupational diseases, including the responsibility of the employer. For the sake of complexity, the individual types of compensation that belong to the injured employ-ee in the event of personal injury and personal injury are also mentioned. A separate chapter in the general part of the thesis is then the given to the characteristics of the area of health and safety at work. This chapter defines occupational safety and health and also specifies the legislation that affects this area. The application part of the thesis aims to clarify the newly created specific problems posed by the current pandemic situation of Covid-19. The first problem area I am re-searching is the recognition of Covid-19 as an occupational disease. In particular, I am looking for answers to the questions of when and under what conditions Covid-19 may be an occupational disease and what professions are entitled to its recognition as an occupational disease. The second problematic area, which has become significantly more important in everyday life with the advent of the pandemic, has been to limit the personal presence of employees in the workplace, unless absolutely necessary. In connection with this restriction, most employers had to resort to working from home (so-called "home office"). However, the Czech legislation was not adequately pre-pared for such a situation. In this part there is the already above mentioned compari-son with the German legislation, which in the end brings my proposals to change the Czech legislation.
