Falcidian Portion and its Reflection in Later Law

Abstract:

Falcidiánská kvarta je čtvrtinou čisté pozůstalosti, kterou si může dědic ponechat i měl-li by dle přání zůstavitele vydat celou pozůstalost odkazovníkům. První část práce (kapitoly 1 a 2) vymezuje základní strukturu římského práva dědického. Těžiště práce spočívá v kapitolách 3 a 4, věnujících se způsobu výpočtu a aplikace kvarty, jakož i jejímu rozšíření na další instituty sukcese mortis causa. Kapitola 5 se věnuje vývoji kvarty v Byzanci, Německu, Švýcarsku, Anglii a Katalánsku. Kapitola 6 se věnuje vývoji kvarty na území České republiky, kde se tato otázka stala aktuální díky § 1598 NOZ.

Abstract:

Falcidian portion is a quarter of the decedents’ estate that can be retained by the heir even if he is asked to give it to someone else. Chapter 1 and 2 serve as an introduction. The main part of the thesis are chapters 3 and 4 that are in detail dealing with problems of application and calculation of the quarter as well as with its extension on other mortis causa dispositions. Chapter 5 examines its development in Byzantium, Germany, Switzerland, England and Catalonia. Chapter 6 examines its development on the territory of the Czech Republic, where it became topical with the new civil code.
