Abstract:

Předkládaná diplomová práce se zabývá problematikou určení platebního místa na směnce. Cílem této práce je vymezení významu platebního místa jako jedné z náležitostí směnky a analýza jednotlivých způsobů určení platebního místa. Úvodní kapitola se věnuje významu platebního místa, přičemž největší důraz je kladen na prezentaci a placení směnky. Druhá kapitola popisuje jednotlivé způsoby určení platebního místa. Stěžejní a poslední kapitola se zabývá analýzou judikatury Nejvyššího soudu a obou vrchních soudů, neboť právě judikatura vzhledem k velmi stručné právní úpravě obsažené v zákoně č. 191/1950 Sb., zákon směnečný a šekový, představuje nezastupitelný zdroj pro výklad a aplikaci tohoto právního předpisu.

Abstract:

The presented thesis discusses the issue of the designation of place of payment in the bill of exchange. The aim of this thesis is to define the significance of the place of payment as one of the requisites of the bill of exchange as well as this thesis aims to analyze the individual ways to designate the place of payment. The first chapter discusses the significance of the place of payment, with the emphasis being put on the presentation and payment of the bill of exchange. The second chapter describes the individual ways of designating the place of payment. The last and at the same time also the main chapter deals with analysis of the Supreme Court judicature as well as the judicature of both the high courts, since it is this judicature that, due to a very brief legal regulation as contained in the Act No. 191/1950 Coll. Bills of Exchange and Cheques, represents an irreplaceable source for the reading and application of this legal regulation.
