Abstract:

Diplomová práce se zabývá výběrem a jmenováním soudců Ústavního soudu. Obsahem práce je nejdříve historický exkurz do období Československa a následně charakteristika procedury výběru a jmenování soudců Ústavního soudu České republiky, přičemž je tato procedura členěna na fázi výběru prezidentem republiky, udělování souhlasu ze strany Senátu a jmenování prezidentem republiky. Kromě toho diplomová práce komparuje současnou proceduru s výběrem a jmenováním ústavních soudců na Slovensku, v Německu či Portugalsku. Závěr práce hodnotí současnou proceduru a nabízí její možné úpravy či změny.

Abstract:

This master's diploma thesis deals with a selection and an appointment of judges of the Constitutional Court. At the beginning, the work deals with a historical excursus until the establishment of Czechoslovakia and then it deals with a profile of the selection procedure and of the appointment procedure of the judges of the Constitutional Court of the Czech Republic. This procedure is divided into three phases: the first phase depends on the president of the republic's choice, the second one on the Senate's approval and the third one on the appointment by the president of the republic. Apart from that, the thesis compares the current procedure with the selection and the appointment of the judges of the Constitutional Court in Slovakia, Germany and Portugal. The end of the thesis evaluates the current procedure and offers possible alterations and changes.
