Delivery to the Address of the Registration Point at Trade Licensing Offices

Abstract:

Diplomová práce je zaměřena na doručování na adresu ohlašovny v praxi živnostenských úřadů. V úvodu krátce vymezuje živnostenskou agendu se zaměřením na doručování písemností. Dále se věnuje obecnému doručování písemností podle správního řádu a metodice doručování písemností. Zabývá se trvalým pobytem a podrobněji jej vymezuje. Jádro práce tvoří rozbor problematiky fikce doručení a doručování písemností na adresu ohlašovny. Jsou zde vymezeny aspekty, které doručování písemností na adresu ohlašovny ovlivňují. Obsah uzavírají výsledky průzkumu doručování písemností na adresu ohlašovny ve správním obvodu živnostenského úřadu Uherské Hradiště. V závěru jsou uvedeny návrhy zákona de lege ferenda pro oblast doručování písemností na adresu ohlašovny. V diplomové práci jsou provedeny rozbory aktuální judikatury týkající se doručování písemností.

Abstract:

My thesis deals with the ways of delivery of documents to the registration office in trade offices. In the opening part, it briefly defines the agenda of the trade office focusing on document deliveries. Then it treats with delivering documents in general in line with the Administration Code and the methodology of delivering written documents. It deals with the place of residence and provides a detailed definition of the concept. The gist of my thesis covers the analysis of fiction delivery and actual delivery of documents to the address of the registration office. I point out the aspects that make a difference in delivering documents to the registration office. Enclosed are the results of a survey of delivering documents to the registration office at the Trade Supervisory Office in Uherske Hradiste. In the final part I present the bills de lege ferenda relating to the delivering of documents to the registration office. My thesis depicts analyses of the current legislation on delivering documents.
