Abstract:

Tato diplomová práce je zpracována na téma obviněný v přípravném trestním řízení. Obviněný má svá práva zaručená vnitrostátním právem, ale též právem evropským. Všechna svá práva může uplatnit ve všech fázích trestního řízení a to jak vlastním konáním, tak prostřednictvím především svého obhájce. Česká republika zaručuje práva obviněného zejména Ústavou, Listinou základních práv a svobod a zákony, upravující trestní řízení. Na poli evropského práva se uplatňují při ochraně práv obviněného Ratifikované a vyhlášené mezinárodní smlouvy o lidských právech a základních svobodách, jimiž je Česká republika vázána, které jsou bezprostředně závazné a mají přednost před zákonem. Již ČSSR podepsala a vyhlásila tzv. Mezinárodní pakt o občanských a politických právech vyhlášený v Chartě OSN, ze kterých vychází práva obviněného a tato byla převzata do našeho právního systému. Z evropského práva zaručuje práva obviněného a to zejména Úmluva o ochraně lidských práv a základních svobod vyhlášená Radou Evropy, kterou ČSFR podepsala a vyhlásila. V průběhu trestního řízení dochází podstatným způsobem do zásahu osobních svobod člověka. Proto je důležité s pohledu obhajoby osoby, proti které se trestní řízení vede, aby nebyla omezována, případně pošlapána práva této osoby. Obviněný uplatňuje svá práva při jednotlivých úkonech trestního řízení, ať již jde o práva při zadržení, vzetí do vazby, vydání věci, při samotném výslechu, při některých zvláštních způsobů dokazování, jako je konfrontace, rekognice, vyšetřovací pokus, rekonstrukce, prověrka na místě a při dalších úkonech.

Abstract:

The topic of this thesis is ?the accused in the preliminary criminal procedure?. The accused has its rights guaranteed by the intrastate law and also by the European law. All his rights may be applied by him in all the stages of the criminal procedure by his own acting as well as through his counsel for defence. The Czech Republic guarantees the rights of the accused especially by the Constitution, the Charter of fundamental rights and freedoms and the laws regulating the criminal procedure. In the field of the European law, the ratified and declared international treaties of the human rights and basic freedoms by which the Czech Republic is bound and which are obligatory and preferred to the law are applied during the protection of rights of the accused. The then Czechoslovak Republic signed and declared the International Covenant of Civil and Political Rights declared in the UN Charter from which the rights of the accused follow and it was taken over into our legal system. As for the European rights, the rights of the accused are protected especially by the Convention of protection of human rights and individual freedoms declared by the Council of Europe and signed and declared by The Czechoslovak Federative Republic. During the criminal procedure, the personal freedom of man is restricted in an essential way. For this reason it is important from the viewpoint of the defence of the person against which the criminal procedure is conducted that the rights of this person are neither restricted nor breached. The accused asserts his rights during the individual acts of the criminal proceedings, be it the rights during the detention, taking into arrest, issue of thing, during the examination, during some special ways of probation, as confrontation, recognition, attempt in investigation, reconstruction, check on the spot and during the next acts.
