Abstract:

Diplomová práce se zabývá problematikou institutu odposlechů a záznamů telekomunikačního provozu. První část je zaměřena na ústavněprávní vymezení odposlechů a záznamů telekomunikačního provozu v kontextu Listiny základních práv a svobod, Úmluvy o ochraně lidských práv a Ústavy. Druhá část diplomové práce se zabývá současnou právní úpravou odposlechů a záznamů hovorů v českém právním pořádku. Nejdříve popisuje zásady legality, legitimity a proporcionality a zákaz retroaktivity, na nichž přípustnost využití odposlechů a záznamů telekomunikačního provozu ve své podstatě spočívá. V následujících kapitolách, třetí a čtvrté, jsou analyzována jednotlivá ustanovení § 88 a § 88a trestního řádu. Další část diplomové práce obsahuje zhodnocení problematiky institutu odposlechů a záznamů telekomunikačního provozu dle zákona o Bezpečnostní informační službě a Vojenském zpravodajství jako orgánů, které mohou odposlechy provádět. Šestá část diplomové práce se zaměřuje na vybrané oblasti aktuální problematiky odposlechů, které dle mého názoru poukazují na jisté problematické otázky vznikající při užití odposlechů. Závěrečná část diplomové práce se věnuje srovnání české a slovenské právní úpravy s popisem vlastní slovenské právní úpravy odposlechů a následně se zaměřuje na podstatné rozdíly mezi českou a slovenskou právní úpravou.

Abstract:

The aim of this thesis is interception and call records, which are mainly regulated by the Criminal Procedure Code. The first chapter is called "the constitutional legal definition of interception and wiretapping". This chapter refers to the Charter of Fundamental Rights and Freedoms, the Convention for the Protection of Human Rights and the Constitution. The first chapter describes the relationship between specific articles of the aforementioned legislation and the issue of interception and wiretapping with reference to the judicature of Constitutional Court and the Supreme Court of the Czech Republic. The second, third and fourth chapters are focused on the Czech legislation of interception and call records. The first part describes the concepts of legality, legitimacy and proportionality and the prohibition of retroactivity in relation to the issue of interception and wiretapping, namely paragraphs 88 and 88a of the Criminal Procedure Code. Chapter 5 is aimed on intelligence interception and wiretapping. This chapter also deals with the Security and Information Service Act, the Military Intelligence Act and the Police of the Czech Republic Act. The sixth chapter deals with current issues. This chapter analyzes selected topics, namely the publication of the interception and wiretapping in media, the issue of communication between the attorney and the accused, the use of interception and wiretapping obtained abroad as proof, the issue of the justification of the order for interception or wiretapping, and the problem of the increasing number of interception and wiretapping with the reference to the Czech judicature of the Constitutional Court and the Supreme Court of the Czech Republic. The seventh chapter deals with the issue of interception and call records under the law of the Slovak Republic. At the end of this chapter are described the largest differences between the Czech and Slovak legislation of interception and wiretapping.
