Parental Agreement with Adoption of the Minor Child

Abstract:

Diplomová práce „Souhlas rodičů osvojovaného nezletilého dítěte“ je rozdělena do dvou částí. V první části se zaměřuje na teoretické vymezení současné právní úpravy týkající se práva rodičů nezletilého dítěte dát souhlas k osvojení. V rámci jednotlivých kapitol je pozornost zaměřena na obecné náležitosti souhlasu a jeho nejčastější podoby. Dále se práce zabývá výjimkami, jež vedou k rozhodnutí o určení, že k osvojení nezletilého není třeba souhlasu rodiče. Své místo v práci zaujímá také problematika rodičů trpící duševní poruchou a specifické postavení nezletilých rodičů. V závěru teoretické části je na úpravu osvojení nazíráno z pohledu mezinárodněprávních předpisů, jimiž je Česká republika vázána. Druhá část práce je zaměřená zcela prakticky a prezentuje výsledky kvantitativního výzkumu realizovaného pro účely práce mezi odborníky na problematiku i širokou veřejností.

Abstract:

The thesis "The consent of the parents of the underaged kids" is divided into two parts. The first part focuses on the theoretical definition of current legislation relating to the rights of the parents of underaged kids to give consent to adoption. Within each chapter is attention focused on the general requirements of consent and its most common form. Furthermore, the work deals with exceptions that lead to a decision, that adoption of udneraged kids does not require the consent of parents. Its place in work takes also the issue of parents suffering from mental disorder and the specific position of underage parents. At the end of the theoretical part is legislation viewed from the perspective of international law, which the Czech Republic is bound to. The second part is focused very practically and presents the results of quantitative research realized for the purpose of work between experts in the field and the general public.
