The Status of Agency Employees in the Czech Republic

Abstract:

Ve své bakalářské práci vymezuji agenturní zaměstnávání, subjekty agenturního zaměstnávání a vykresluji vznik, obsah a zánik vztahů mezi těmito subjekty. Dále zkoumám pozici agenturních zaměstnanců na českém trhu práce a zabývám se odlišnostmi jejich postavení od postavení zaměstnanců kmenových včetně výhod a nevýhod z něj vyplývajících. Po popsání nejproblematičtějších oblastí srovnávám právní normy týkající se agenturního zaměstnávání s příslušnými právními normami Spolkové republiky Německo a Slovenské republiky. Cílem bakalářské práce je na základě provedené komparace vytvořit návrh takové změny právního řádu, která by vedla k optimalizaci postavení agenturních zaměstnanců v České republice. Můj výzkum ukazuje, že nejvhodnějším způsobem je vymezení pojmu „pracovní a mzdové podmínky“, rozšíření právní ochrany poskytované agenturním zaměstnancům, omezení maximální možné doby přidělení agenturního zaměstnance k jednomu uživateli a zavedení automatického vzniku právního poměru na dobu neurčitou mezi agenturním zaměstnancem a uživatelem v případě překročení maximální možné doby dočasného přidělení.

Abstract:

In my bachelor's thesis, I define agency employment and subjects of agency employment and depict the origin, content and demise of relationships between these subjects. Furthermore, I examine the position of agency employees in the Czech labour market and deal with the differences in their position from the position of regular employees, including the advantages and disadvantages resulting from it. After describing the most problematic areas, I compare the legal norms regarding agency employment with the relevant legal norms of the Federal Republic of Germany and the Slovak Republic. The aim of the bachelor's thesis is, based on the comparison made, to create a proposal for a change in the legal system that would lead to the optimization of the position of agency employees in the Czech Republic. My research shows that the most suitable way is to define the concept of ‘working and wage conditions, extend the legal protection provided to agency workers, limit the maximum possible period of assignment of an agency worker to one user and introduce an automatic legal relationship for an indefinite period between an agency worker and a user in a case of exceeding the maximum possible period of temporary assignment.
