Abstract:

Trestná činnost v silničním provozu je svým způsobem specifickým druhem trestné činnosti. V souvislosti s rozvojem lidské společnosti dochází k podstatnému nárůstu v počtu budování pozemních komunikací, celkové infrastruktury a zejména ke zvýšení počtu vozidel, které se silničního provozu zúčastňují. S tím souvisí také stále větší počet účastníků silničního provozu, ať již samotných řidičů, spolucestujících nebo dalších účastníků, jako jsou cyklisté, nebo chodci. Každý z nás se tedy po celý život nějakým způsobem silničního provozu účastní. Proto je u této trestné činnosti zajímavé to, že se může týkat v podstatě každého z nás. Nejenom, že se můžeme stát pachatelem této trestné činnosti, když třeba nezvládneme své vozidlo a společenská škodlivost následku bude taková, že se bude jednat o trestný čin, ale v podstatě bez svého zavinění a bez jednání, které by nějakým způsobem vůbec zapříčinilo tuto trestnou činnost, se můžeme stát jeho obětí. Klasickým případem je, když se zúčastníme silničního provozu jako chodec, který přechází přes přechod pro chodce a narazí do nás vozidlo nebo při řízení vozidla nám vjede druhé vozidlo z protisměru a dojde ke střetu vozidel. Z charakteristiky trestných činů v silničním provozu je možno také říci, že tyto trestné činy jsou páchány převážně osobami, které jsou k pravidlům silničního provozu odborně vyškoleny. Toto se týká řidičů motorových vozidel, kdy nezbytným předpokladem je absolvování autoškoly a získání příslušného řidičského oprávnění. Ostatní účastníci silničního provozu, jako cyklisti a chodci, by měli být s pravidly silničního provozu seznámeni v souladu se zásadou „Ignorantia iuris non excusat“. Provoz na silničních komunikacích nám obecně upravuje zákon č. 361/2000 Sb., o provozu na pozemních komunikacích, ve znění pozdějších předpisů (dále jen ZPPK). Co je silničním provozem a jaké jsou kategorie komunikací, nám upravuje zákon č. 13/1997 Sb. o pozemních komunikacích, ve znění pozdějších předpisů (dále jen ZPK). U trestných činů v silničním provozu je nejdůležitějším hlediskem osoba pachatele. Specifikum této trestné činnosti spatřuji v tom, že se zde jedná v převážné míře o osoby bez kriminální minulosti. Zpravidla tedy může jít o osoby, které jsou bezúhonné, které nemají negativní vztah ke společnosti, a přesto se této trestné činnosti mohou dopustit. Naproti tomu jsou zde také osoby, které takový vztah ke společnosti nemají, tuto trestnou činnost páchají i opakovaně. Typickým příkladem jsou případy opakovaného řízení motorového vozidla pod vlivem alkoholu, kdy pachatel ve stavu vylučujícím způsobilost opakovaně řídí motorová vozidla. V některých případech hraje roli také kriminální minulost pachatele, nerespektování nebo neznalost zákonů celkově. Dalším kritériem jsou jiné vlivy, jako stav silniční komunikace, povětrnostní podmínky, hustota silničního provozu, vozidlo a jeho stav, chování jiných účastníků silničního provozu apod. Již ze samotné podstaty této trestné činnosti je zřejmé, že se ve většině případů jedná o trestné činy se zaviněním z nedbalosti, kdy se jedná o nedbalost vědomou či nevědomou. Protože se silničního provozu zúčastňují vozidla různých kategorií, hmotností a velikostí, kdy také dosahují i různých rychlostí, lze v případě úmyslného trestného činu také uvažovat o tom, že je možno použít vozidlo i jako zbraň. I když takováto úmyslná trestná činnost v silničním provozu je spíše výjimečná, je možno se v minulosti přesvědčit, že i k takovým případům již došlo . na poruchové a ohrožovací povahy. Typickým příkladem trestného činu ohrožovací povahy v silniční dopravě je např. trestný čin Ohrožení pod vlivem návykové látky dle § 274 odst. 1 zák. č. 40/2009 Sb. Trestní zákoník, ve znění pozdějších předpisů (dále jen TZ). A v 2. odstavci pod písm. a) uvedeného trestného činu (jedná se o kvalifikovanou skutkovou podstatu) je zřejmá poruchová povaha trestného činu v silniční dopravě, kdy již dojde k dopravní nehodě, jinému se ublíží na zdraví, dojde k větší škodě na cizím majetku nebo jinému závažnému následku. Trestným činům se budu věnovat v bakalářské práci dále. Z celospolečenského hlediska se tedy v případě trestných činů v silniční dopravě stává velký problém, neboť jejich následky z morálního a finančního hlediska ohrožují celou společnost, zejména pokud se to týká dopravních nehod. Je třeba také říci, že valná většina jednání a následků spadá do oblasti přestupků , protože však cílem seminární práce jsou trestné činy, nebudu se zde o nich zmiňovat. Z údajů ČKP ze dne 20. 9. 2010 je možno vyčíst, že za posledních deset let narostl celkový objem škod při dopravních nehodách z hodnoty 7,5 mld. Kč pro škody vzniklé v r. 2000 na téměř 14,3 mld. Kč pro škody vzniklé v r. 2009. Z jejich analýzy vyplývá, že vyšší nárůst nejvíce vyplývá ze škod na zdraví, které jsou několikanásobně větší než u škod v minulosti. Myslím si, že v poslední době k tomuto přispěl mimo jiné i nový TZ, který si kladl za cíl větší ochranu života a zdraví jako takového. S tím také souvisí různé typy odškodnění, léčebných výloh, finančních náhrad apod. Naopak je tedy možno říci, že čím větší finanční náhrady při škodách na zdraví, tím závažnější trestný čin. Typickým trestným činem z tohoto hlediska je v silničním provozu dále např. usmrcení z nedbalosti, ublížení na zdraví z nedbalosti, nebo těžké ublížení na zdraví z nedbalosti. Základní myšlenkou této bakalářské práce je ukázat, že tyto trestné činy se můžou týkat kohokoliv a jsou velmi sledované celou společností. Naproti tomu jsou jiné trestné činy, se kterými se pro jejich povahu zřejmě po celý život nesetkáme. Jedná se např. o trestné činy hospodářské povahy, trestné činy vojenské, trestné činy proti České republice, které mají úzký okruh pachatelů.

Abstract:

Criminal activities in the road traffic are a specific type of criminal activities in a way. In connection with the development of human society it comes to an essentials increase in the number of building land communications, the whole infrastructure and especially to the increase in the number of the vehicles that take part in the road traffic. It is also connected with the ever-increasing number of the road users; let it concern the drivers themselves, the fellow-travellers or other road users, such as the bicyclists or the pedestrians. Each of us participates in the road traffic in a way throughout all his or her life. Therefore it is interesting about these criminal activities that they can concern each of us in fact. You cannot only become a perpetrator of the criminal activities if e.g. you do not manage to drive your vehicle and the social harmfulness of the after-effect is such that it will be regarded as a criminal offence, but you can become a victim without your own fault and without an action which would cause these criminal activities in a way. Classical examples are: You participate in the road traffic as a pedestrian who is crossing a road at the pedestrian crossing and is crashed into by a vehicle or when driving the vehicle another vehicle is coming into your lane from the opposite direction and the vehicles collide with each other. When speaking about the characteristic of the criminal offences in the road traffic we can also say that these criminal offences are prevailingly committed by people who are professionally trained to use the traffic rules. It concerns the drivers of the motor vehicles for whom finishing the driving schools and acquiring the driving licenses is absolutely necessary. The other road users, such as the bicyclists and the pedestrians should be acquainted with the traffic rules in accordance with the principle “Ingnotantia iuris non excusat”. The traffic on the road communications is generally adjusted by law no. 361/2000 SB. (Statute Book) on the traffic on the land communications, as subsequently amended. What is the road traffic and what are the categories of the communications, it is adjusted by law no. 13/1997 SB. on the land communications, as subsequently amended. As for the criminal offences in the road traffic the most important aspect is the person of the perpetrator. I find the particularity of these offences in the fact that they prevailingly concern people without criminal records in the past. As a rule, the people who can be concerned are those who have clean criminal records, who do not have negative attitudes to the society and in spite of this they can commit criminal offences. On the other hand there are also people who do not have such attitudes to the society and commit offences even repeatedly. The typical examples are the cases of the repeated driving a motor vehicle under the influence of alcohol when the perpetrator repeatedly drives motor vehicles in a state of health excluding the capability to do so. In some cases a big part is played by the criminal past of the perpetrator, the disrespect fort the laws of their total ignorance. The further criteria are other influences, such as the condition of the road communications, weather conditions, the behavior of other road users etc. Then taking the essence of the criminal activities into account it is obvious that in most cases it concerns the criminal offences caused by negligence, either wilful or unwilful. As there are vehicles of various categories, weights and sizes that take part in the road traffic and reach various speeds we can also consider the fact the vehicle can be used as a weapon in case of a wilful criminal act. Although such wilful criminal activities in the road traffic are rather exceptional we can verify that such cases happened in the past. ample of a criminal offence of the danger character in the road traffic is e.g. the criminal offence of Danger under the influence of an addictive substance under article 274 paragraph 1 law no. 40/2009 SB. the Criminal Code, as subsequently amended (further only CC). And in paragraph 2 under letter a) of the quoted criminal offence (it concerns the qualified fact of the case) there is an obvious breakdown (failure) character of the criminal offence in the road traffic when it already comes to a traffic accident, there is caused bodily harm to somebody else, it comes to somebody else’s property damage or another serious consequence. I will discuss the criminal offences further in my bachelor’s work. Thus, with the respect to the whole society, criminal offences become a big problem because from the moral and financial point of view their consequences endanger the whole society, especially as far as the traffic accidents are concerned. Needless to say most actions and consequences belong to the area of offences; however, as the criminal offences are the aim of the seminar work I will not mention them here. From the dates of the Czech Bureau of Insurers from the 20th September 2010 we can read that in the past ten years the total volume of the traffic accident damage has increased from the value of 7,5 billion Czech crowns referring to the damage arisen in the year 2000 to almost 14,3 billion Czech crowns referring to the damage arisen in the year 2009. Their analysis shows that a higher increase mostly arises from the bodily harm cases whose number is many times higher than it was in the past. I think that besides other things this effect has recently been contributed by the new CC, too, whose aim was a bigger protection of life and health. It is also connected with various types of compensation, medical expenses, financial compensation etc. On the contrary, we can say that the higher financial compensation of the bodily harm is, the more serious the criminal offence is. From this point of view a typical criminal offence in the road traffic is e.g. killing from negligence or (actual) bodily harm from negligence or grievous bodily harm from negligence. The basic idea of this bachelor’s work is to show that these criminal offences can concern each of us and are followed by the whole society very much. To the contrary, there are other criminal offences we will obviously not encounter because of their character throughout all our lives. It concerns e.g. the criminal offences of the economic character, the military criminal offences, and the criminal offences against the Czech Republic which have a close circle of the perpetrators.
