Abstract:

Ireinová, A. Dopady Pilíře I. a II. na korporátní zdanění s důrazem na bezpečné přístavy a efektivní míru zdanění. Diplomová práce. Brno: Mendelova univerzita v Brně, 2024. Diplomová práce se zabývá dopady Pilíře I. a II. na korporátní zdanění, přičemž klade důraz na bezpečné přístavy a efektivní míru zdanění. V rámci I. pilíře je práce zaměřena na určení ziskovosti u marketingových a distribučních činností, a to skrze jednotlivé geografické oblasti a kategorie podniků. Dle výsledků se toto rozpětí z celosvětového hlediska pohybuje od -0,80 do 10 %. V souvislosti s II. pilířem zkoumala práce nadnárodní společnost Siemens AG, jejíž dceřiné společnosti operují ve 46 zemích světa. U jurisdikcí, ve kterých daná společnost nedosahovala minimální globální sazby daně 15 %, byla následně vyměřena dorovnávací daň, přičemž dle výsledků by nejvyšším výnosem disponovala Velká Británie. Přestože byla zkoumána pouze jedna nadnárodní společnost, celková výše dorovnávací daně je přes 390 mil. dolarů, výsledky této práce tedy opodstatňují důležitost dvoupilířového řešení.

The diploma thesis examines the effects of Pillars I and II on corporate taxation, with an emphasis on safe harbours and effective tax rates. Within Pillar I, the thesis focuses on determining profitability for marketing and distribution activi-ties, through each geographic area and category of business. According to the results, the range from a global perspective is between -0,80 and 10 %. In the context of Pillar II, the thesis examined the multinational company Siemens AG, whose subsidiaries operate in 46 countries. For jurisdictions where the company did not reach the minimum global tax rate of 15 %, a top-up tax was subsequently assessed, with the results suggesting that the UK would have the highest yield. Although only one multinational was examined, the total amount of the top-up tax is over $390 million, so the results of this thesis justify the importance of a two-pillar solution.
