International Cooperation in Tax Administration in the Area of Assessment on Incomes

Abstract:

Ve své rigorózní práci na téma: „Mezinárodní spolupráce při správě daní v oblasti daně z příjmu“ jsem se snažila, jak již uvádím v úvodu své práce, navázat na diplomovou práci a zpracovat část, která se týká „Mezinárodní spolupráce při správě daní v oblasti daně z příjmu“ podrobněji. Mojí snahou bylo zaměřit se konkrétně na dvě z oblastí, ve kterých se odehrává mezinárodní spolupráce při správě daní a to daň z příjmů a vymáhání. Při zpracovávání své rigorózní práce jsem zjišťovala různé nedostatky a problémy, které tato oblast přináší, současně jsem si za pomoci pracovníků MF ČR a FŘ v Brně neustále ověřovala, jak málo existuje praktických zkušeností. Své závěry jsme se snažila zformulovat do úvah d e l e g e f e r e n d a k uvedené problematice, které shrnuji následovně: • Nutnost uzákonění konkrétních lhůt obecně závazným právním předpisem, včetně jejich vynutitelnosti v rámci mezinárodní spolupráce při správě daní • nezbytnost uzákonění jednotného úředního jazyka, používaného v rámci mezinárodní spolupráce při správě daní • uzákonění povinného poskytování určitého typu informací, a to pozitivním výčtem, nikoliv pouze formou negativního výčtu • zavedení osvobození od poplatků peněžním ústavům za převod peněz v rámci mezinárodní spolupráce při vymáhání některých finančních pohledávek • zvážení sjednocení penalizačních, příp. úrokových sazeb, plynoucích z daňových nedoplatků a to v rámci celé EU • zjednodušit administrativu mezi jednotlivými státy EU v rámci výměny informací v oblasti daně z příjmu a v oblasti vymáhání některých finančních pohledávek, výměna informací by měla probíhat pouze elektronicky, včetně zasílání exekučního titulu V započatém úsilí věnovat se oblasti mezinárodní spolupráce při správě daní bych ráda pokračovala a volně na ně navázala i při psaní disertační práce, kde se hodlám zaměřit na „Mezinárodní spolupráci při správě daní v oblasti nepřímých daní,“ tedy daně z přidané hodnoty a spotřebních daní. Tato oblast je prozatím v praktickém daňovém řízení nejvíce frekventovaná. Pevně věřím, že se mi tak podaří vytvořit ucelený materiál, který se může stát jakýmsi právně teoretickým a současně i praktickým odrazovým můstkem dalšího vývoje uvedené oblasti, jakožto jednotného celku.

Abstract:

As I mentioned in the introduction to my work, in my advanced Master’s thesis themed “International Cooperation in the Administration of Taxes in the Area of Income Tax”, I endeavor to follow up with the diploma thesis and further develop the part concerning “International Cooperation in the Administration of Taxes in the Area of Income Tax”. I attempted to concentrate specifically on two of the areas where international cooperation in the administration of taxes takes place, namely the income tax and claiming. In drawing up my advanced Master’s thesis, I identified various shortcomings and problems that exist in the field and, with the assistance of the personnel of the Ministry of Finance of the Czech Republic and the Financial Directorate in Brno, I repeatedly witnessed how little practical experience there is. I tried to lay down my conclusions in d e l e g e f e r e n d a contemplations on the issue, which I summarize as follows: • necessity to enact specific deadlines by a generally binding legal regulation, including their enforceability within the international cooperation in the administration of taxes • necessity to enact a uniform legal language used within the international cooperation in the administration of taxes • enactment of the obligatory provision of a certain type of information by means of a positive rather than just negative listing • introduction of the exemption from fees for banks for the transfer of money within the international cooperation in the claiming of some financial receivables • considering the unification of the penalty rates and perhaps also interest rates resulting from tax arrears within the entire EU • simplification of administration between the individual EU states within the exchange of information in the area of income tax and in the area of claiming some financial receivables; the exchange of information should take place only electronically, including the sending of the distraint title. I would like to continue my endeavors in the area of international cooperation in the administration of taxes and generally follow up with the subject in drawing up my dissertation, where I intend to concentrate on “International Cooperation in the Administration of Taxes in the Area of Indirect Taxes”, i.e. the value added tax and excise duties. The aforementioned area has been the most frequent in practical tax-related proceedings to date. I firmly believe that I will succeed in creating an integrated material that may become a resource of legal theory and simultaneously practice for a further development of the field as a whole.
