Abstract:

Tato práce podává analýzu fungování policie v oblasti výkonu státní správy v rámci působnosti norem správního práva z hlediska teorie i praxe. Dříve, než jsem se v obsahu své práce zaměřil na policii samotnou, zmiňuji se o problematice bezpečnostních sborů. V úvodní kapitole jsou představeny veškeré bezpečnostní sbory, které v současné době působí v rámci České republiky, a to z hlediska obecných témat, jež jsou pro ně společná. Obsah této kapitoly je teoretickým základem pro další části práce. Práce je rozdělena do čtyř samostatných kapitol, které na sebe obsahově navazují, a postupně odpovídají na tři základní otázky související s fungováním policie. Jedná se nejprve o odpověď na otázku „kdo“, to znamená, že je zde policie představena z hlediska statického, tedy z hlediska její organizační struktury. Dále odpovídám na otázku „kde“, což představuje vymezení její působnosti v rámci výkonu státní správy realizované na základě norem správního práva. A nakonec zde lze nalézt též odpověď na otázku „jak“, kdy v této části práce je policie představena z hlediska dynamického (funkčního), tedy z hlediska vymezení forem její činnosti. Při tvorbě své práce vycházím především z vlastních zkušeností, postřehů a poznatků, získaných během svého působení v řadách policie.

Abstract:

This thesis provides an analysis of the functioning of the police in the area of governance falling within the scope of administrative law rules, from both theoretical and practical perspectives. Before focusing on the police as such in my thesis, I discuss aspects of public security forces. The initial chapter introduces all the public security forces that are currently active in the Czech Republic and looks at some general topics which are common for all such forces. The contents of this chapter form a theoretical background for the following parts of the thesis. The thesis is divided into four chapters that follow each other and provide answers, each in its turn, to the three basic questions related to the functioning of the police. First, an answer is provided to the question “who”, i.e. the police is introduced in structural terms – in respect of its organisational structure. Second, an answer is provided to the question “where”, by defining the competences of the police within governance carried out on the basis of administrative law rules. And finally, the question “how” is also answered, where in the respective part of the thesis the police is presented in terms of its dynamics (functioning), i.e. by defining the forms of its activities. I based my considerations in drawing up the thesis particularly on my own experience, observations and findings obtained during my work in the police.
