Abstract:

Diplomová práce je zaměřena na postavení dítěte v rámci rozpadu manželského či partnerského vztahu. Konkrétně se zabývá postavením dítěte v procesu rozhodování o jeho výchově, zejména pak participačními právy nezletilých dětí, která jsou zajišťována mezinárodně právními dokumenty. Cílem diplomové práce je zjistit, jaké má nezletilé dítě postavení v procesu rozhodování o jeho výchově v rámci rozvodu či rozchodu rodičů. Teoretická část práce se věnuje charakteristice rozvodu a partnerského vztahu, dále je zde popsán proces rozhodování o výkonu rodičovské odpovědnosti a specifikovaná jsou také participační práva dětí. Cílem výzkumné části je zjistit, zda soud zjišťuje názor nezletilého dítěte v záležitosti jeho výchovy, v rámci rozvodu či rozchodu rodičů, popřípadě jakou formou a zda při rozhodování o svěření dítěte do výchovy, věnuje zjištěnému názoru dítěte patřičnou pozornost. K dosažení cíle je využita kvantitativní výzkumná strategie.

Abstract:

The diploma thesis is focused on the position of the child in the context of the marriage or partner relationship breakdown. Specifically, it deals with the position of the child in the decision-making proces about his / her upbringing, especially the participation rights of minors that are ensured by international legal documents. The aim of the diploma thesis is to find out what a minor child has a position in the decision-making process about his / her upbringing in divorce or parental breakdown. The theoretical part of the diploma thesis deals with the characteristics of the divorce and the partnership relationship, describes the process of decision-making on the performance of parental responsibility and the children's participation rights are also specified. The aim of the research section is to find out if the court finds out the opinion of a minor child in the matter of his / her upbringing, divorce or parental breakdown, eventually in what form and if the court takes into account whed deciding to entrust the child to the observed child's opinion. A quantitative research strategy is used to achieve the goalof the diploma thesis.
