Abstract:

Obecným tématem této bakalářské práce je „Reforma zakládacích smluv ES/EU“, přičemž prostor bude věnován konkrétně komparaci současné podoby čtyř nejdůležitějších institucí Evropské unie (dále EU), tedy Evropské rady, Evropské komise, Rady EU a Evropského parlamentu, s jejich reformou navrženou v Lisabonské smlouvě. Cílem práce je potvrdit nebo vyvrátit následující hypotézu: „Návrh reformy institucí Evropské unie obsažený v Lisabonské smlouvě povede v případě jejího schválení k dalšímu omezení suverenity členských států na úkor EU.“ Pro tento účel bude suverenita státu chápána jako možnost nezávislého a neomezeného výkonu moci na území daného státu. S ohledem na téma práce a stanovenou hypotézu bude při zpracování využita především metoda komparativní analýzy primárních pramenů, zvláště pak primárního práva ES/EU. Vzhledem ke zvolené metodě zpracování a aktuálnosti tématu není předpokládáno využití četné sekundární literatury.

Abstract:

The general topic of this bachelor thesis is “The reform of the founding EC/EU Treaties”. The main focus is on the reform of main European Union’s institutions (European Council, European Commission, Council and European Parliament) that is included in the Treaty of Lisbon. The aim of this thesis is to confirm or overcome following presumption: “The European Union’s institutional reform included in the Treaty of Lisbon is in the case of the ratification of the Treaty leading to further limitation of member states´ sovereignty. The first chapter of this thesis is focused on the development of the EC/EU primary law from its foundation till the Lisbon Treaty. The second chapter is devoted to the European institutions´ reforms initiated by previous EC/EU treaties. The main chapter is trying to analyze institutional reforms proposed by the Treaty of Lisbon and in the conclusion there are mentioned the impacts of these reforms on the member states´ sovereignty. The most important change is connected with the extension of the usage of QMV voting in the Council. This means that in contrast to unanimous voting several states may be overvoted and the proposal will be accepted despite of their disagreement. The European Commission is established on supranational foundations and that is why it does not support sovereignty of the EU member states. This institution is independent on the member states´ will and executes its duties in order to gain benefits for the whole European Communities. The potential threat to the member states´ sovereignty may be seen in connection with the position of the High Representative of the EU for the foreign and security policy. His aim will be to ensure the unanimous EU voice in the field of the foreign and security policy which is the one that is most connected with member states´ national interests. The Treaty of Lisbon markedly strengthens competences of the European Parliament, e.g. legislative a financial ones. But these competences do not influence the member states´ sovereignty because the European Parliament represents the will of European citizens. The reform of the European Council will not influence member states either because these are just the highest representatives of the member states who are sitting in this institution.
