Property Protection Problems – the Publicity of the Real Estate Cadastre
Abstract:
Práce se zabývá nedostatečným uplatněním zásady materiální publicity v katastru nemovitostí a problémy, které v důsledku toho zatěžují nabyvatele nemovitostí. Zkoumána je tato zásada v minulosti i současnosti, s ohledem na její rozdílnou úpravu a aplikaci. Shrnuje současné nedostatky a judikaturu. Závěr je věnován budoucímu vývoji.
Abstract:
The work deals with the lack of application of the principle of material publicity. As a result of this purchasers of real estate are facing difficulties. Principle is examined in the past and present with regard to its different treatment and application. It summarizes current problems and jurisprudence . The conclusion is devoted to future development.
