The Law and the Morality and Their Reception by Immanuel Kant

Abstract:

Práce rozebírá vztah práva a morálky, jakožto věčné téma právní filosofie, v perspektivě německého osvícenského filosofa Immanuela Kanta. Popisuje propojení práva a morálky a vysvětluje Kantův kategorický imperativ, obecný rozumový princip tvorby autonomní morálky. Pojednává o juspozitivismu a jusnaturalismu v konfrontaci s etikou, lidských právech a konstitutivním egoismu, Kantových postupných aproximacích, absolutních a fundamentálních právech, kulturně-geografických vlivech na pojetí lidských práv, lidských právech v souvislosti s principem svobody a demokracie a právní ideji jako kulturně-filosofickém pojmu a všechna tato témata konfrontuje s Kantovými myšlenkami, především pak s principem kategorického imperativu, který je ústředním bodem celé práce. Kromě Immanuela Kanta práce cituje i jiné kapacity, jakými jsou třeba Thomas Hobbes, John Rawls nebo Gustav Radbruch. Odkazy na jejich díla tu však slouží zejména jako podpora pro zhodnocení Kantova pohledu. V závěru jsou zrekapitulovány závěry z jednotlivých kapitol a autor práce hodnotí přínos Kantovy teorie.

Abstract:

The work analyses a relationship between the law and the morality – as the everlasting topic of legal philosophy – in perspective of German enlightenment philosopher Immanuel Kant. It describes a connection of the law and the morality and explains Kant’s categorical imperative, the general rational principle of autonomous morality creation. It discusses legal positivism and iusnaturalism in confrontation with ethics, human rights and constitutional (psychological) egoism, Kant’s gradual approximations, absolute and fundamental rights, cultural-geographic influences on human rights conception, human rights relating freedom and democracy principle and legal idea as the cultural-philosophical concept and confronts all these topics with Kant’s ideas, especially with the categorical imperative principle, which is the central point of the work. Besides Immanuel Kant, the work cites other authorities as well, as for example Thomas Hobbes, John Rawls or Gustav Radbruch. However, references to their legacy serve mainly as a support for evaluation of Kant’s point of view. In the ending, conclusions of individual chapters are recapitulated and the author of the work rates Kant’s theory’s credit.
