The Kuttenberger Decree

Abstract:

Soužití univerzitních národů na pražské předhusitské univerzitě je pod vlivem událostí souvisejících s vydáním a prosazením Dekretu kutnohorského nazíráno jako konfliktní. Pozdější negativní reakce bývalých pražských univerzitních mistrů, působících po roce 1409 především na lipské a vídeňské univerzitě, stejně jako reakce českých mistrů, velebících odchod Němců, soužití národů na pražské univerzitě nadalo přídech xenofobního nacionalismu, jehož kořeny měly sahat až do poloviny 80. let 14. století. V disertační práci se snažím ukázat, že spory o obsazování míst v mistrovských kolejích a o reformu univerzitních statut z let 1384-1385, stejně jako spor o působnost konzervátorů práv pražské alma mater z 90. let 14. století, byly jedinými, korporativně-nacionálně motivovanými a traktovanými spory, které do roku 1409 na pražské univerzitě propukly. Na jejich základě rozhodně není možné mluvit o soužití univerzitních národů jako o soužití nacionálně vyhroceném. První část disertační práce tvoří zevrubná analýza „základního univerzitního zákona“, concordia nacionum, který upravoval univerzitní správu do roku 1409. Druhá část sleduje „zlatá 90. léta 14. století“, v nichž došlo k posílení univerzitní autonomie a k hmotnému zajištění českého univerzitního národa. Ve třetí části je věnována pozornost disciplinaci pražských univerzitních mistrů a studentů, jež dosavadní spolupráci univerzitní mistrů všech národů pod vlivem odlišných názorů na Jana Viklefa narušila. V poslední, nejrozsáhlejší části práce, je představena analýza příčin a důsledků spojených s vydáním Dekretu kutnohorského, s důrazem na dopad královského mandátu na české reformní hnutí a na omezování akademické svobody panovníkem, arcibiskupem i univerzitními mistry samotnými. Teprve pod jejich vlivem totiž pražská univerzita ztratila svůj univerzální charakter a stala se konfesně uzavřenou univerzitou bez studentů.

Abstract:

Historians usually present a coexistence of the university nations at the pre-Hussite University of Prague as conflicting. This is caused by the events related to the publication and enforcement of the Kuttenberger Decree, including the negative reactions of the former university masters who, after leaving Prague in 1409, established themselves at the universities of Leipzig and Vienna, and the reactions of the Czech masters who hailed the departure of the Germans. These events retrospectively influenced the view of the coexistence of the university nations as having flavour of the xenophobic nationalism whose roots allegedly went back to the 1380s. In my dissertation I attempt to show that the disputes about the positions in the master college, about the reform of the university statutes in 1384-1385, and about the activities of protectors of the Prague University rights in the 1390s are the only disputes motivated by the corporative and national reasons prior to 1409. These disputes, however, do not allow us to speak of the coexistence of the university nations as conflicting in nationalistic terms. The first part of the dissertation consists of a detailed analysis of the „key university law“, concordia nacionum, which defined the university administration before 1409. The second part deals with strenghtening of the university authonomy and making the alma mater financially secured in „the golden 1390s“. The third part focuses on the disciplination of the masters and students which followed the differentiation in the views on John Wycliffe and which destroyed previous cooperation among the Prague university masters of all nations. The last and most extensive part is devoted to the analysis of the causes and consequences of the Kuttenberger Decree, especially to the impact of the royal decree upon the Czech reform movement and to the restrictions of the academic liberties by the ruler, archbishop and the university masters themselves. After all, it was this activity of the university masters which influenced the universtity’s transitition from the universalist educational institution to the confessional university without students.
