Abstract:

Autorka se v předkládané rigorózní práci s názvem ,,Osoby jako prostředky v boji s organizovaným zločinem “ zaměřila na využívání osob, které český právní řád upravuje, jako zdrojů informací při odhalování tohoto nežádoucího jevu. Podstatou práce je srovnání informátora, spolupracujícího obviněného a agenta se zaměřením na efektivnost jejich využívání. Ačkoli jde o instituty, které jsou součástí právního řádu již několik let, jde o dlouhodobě aktuální tématiku, jež je stále předmětem odborných diskuzí. Přestože je právní úprava vybraných institutů soustředěna do několika málo ustanovení, praxe ukázala její nedostatky, které je třeba odstranit, a to zejména v oblasti jejich využitelnosti. Rigorózní práce se v prvé části věnuje teoretickému vymezení organizovaného zločinu, jeho historickému vývoji na území České republiky, obecnému pojednání o operativně pátrací činnosti a jejímu kontextu se základními zásadami trestního práva procesního. Autorka také provádí srovnání se zahraniční právní úpravou na Slovensku a v Rakousku a nechává se inspirovat prvky zde fungujících modelů. V dalších částech rigorózní práce jsou podrobně rozebrány instituty informátora, spolupracujícího obviněného a agenta včetně vymezení příčin jejich neefektivnosti, zejména nepředávání kontaktů a zkušeností mezi policisty, závislost přiznání statutu spolupracujícího obviněného na úvaze státního zástupce a formu jeho rozhodování, rozšíření na řízení o zločinech, nevyužitelnost poznatků informátora v řízení před soudem či problematické pronikání do oblasti hospodářské kriminality. Autorka předestírá možná řešení de lege ferenda, která vychází např. z vlastní analýzy dosavadních rozhodnutí, v nichž figuroval spolupracující obviněný, praktických poznatků orgánů činných v trestním řízení, výkladu právních předpisů a vlastní praxe. Ačkoliv autorka považuje všechny výše uvedené instituty za přínos v boji s organizovaným zločinem, současný stav právní úpravy vnímá jako nedostačující a plně nevyužívající potenciál těchto prostředků. Kriticky se také staví k novele, která rozšířila možnost využití spolupracujícího obviněného i v řízení o zločinech a k návrhům o implementaci informátora do trestního řádu. Naopak přichází s myšlenkou důvěrníka a protikorupčního agenta, jež by mohly výrazně pomoci při potírání organizovaného zločinu, zejména korupce.

Abstract:

In the presented rigorosum thesis entitled "Persons as means in the fight against organized crime", the author focused on the use of persons regulated by the czech rule of law as sources of information in detecting this undesirable phenomenon. The essence of the thesis is a comparison of the informant, the cooperating defendant and the police agent with a focus on the effectiveness of their use. Although these are institutes that have been part of the legal order for several years, this is a long-standing theme that is still the subject of professional discussions. Although the legal regulation of selected institutes is concentrated in a few provisions, practice has shown its shortcomings that need to be remedied, especially in the area of their applicability. The first part of the rigorosum thesis deals with the theoretical definition of organized crime, its historical development in the Czech Republic, a general treatise on operative search activity and its context with the fundamental principles of criminal procedural law. The author also makes a comparison with foreign legislation in Slovakia and Austria and is inspired by elements of the functional models here. In next parts of the rigorosum thesis, the institutes of informant, cooperating defendant and police agent are analyzed in detail, including the definition of the causes of their inefficiency, especially non-handing over of contacts and experiences between police officers, the dependence of granting the procedural status of cooperating defendant at the discretion of the public prosecutor, the form of its decision-making, an extension to criminal proceedings, unusability of the informant in court proceedings or problematic infiltration into the area of economic crime. The author presents possible solutions de lege ferenda, which are based, for example, on her own analysis of previous judgments in which the cooperating defendant figured, practical knowledges of law enforcement authorities, interpretation of legislation and own practice. Although the author considers all the above-mentioned institutes to be beneficial in the fight against organized crime, she perceives the current legislation as insufficient and not fully utilizing the potential of these means. She is also critical of the amendment, which extends the possibility of using the institute of the cooperating defendant in criminal proceedings and of proposals for the implementation of an informant in the Criminal procedure code. On the contrary, it comes up with the idea of a confidant and an anti-corruption agent, which could significantly help with combating of organized crime, especially corruption.
