Insurance Fraud

Abstract:

Diplomová práce se zabývá problematikou pojistných podvodů spojených s pojištěním motorových vozidel. Podvodné jednání při uplatňování pojistného plnění v souvislosti s motorovými vozidly, tvoří výraznou část nezákonného jednání, páchaného směrem k pojišťovacím ústavům v České republice a je závažným problémem na pojistných trzích. Pojišťovnám, které vynakládají značné finanční prostředky na prevenci a odhalování uvedeného druhu protiprávního jednání, způsobují podvody u motorových vozidel nemalé ekonomické ztráty. Součást preventivní činnosti pojišťoven proti pojistným podvodům tvoří úzká spolupráce s Policií ČR. Obrana proti pojistnému podvodu je náročná záležitost, při které je v pojišťovnách kladen důraz na kvalitní risk management, pokud však již vyvstane důvodné podezření, že byl spáchán trestný čin, svou úlohu zde začínají plnit orgány činné v trestním řízení, neboť shora uvedené jednání je v právním řádu České republiky zakotveno jako trestný čin pojistného podvodu.

Abstract:

This thesis deals with insurance fraud related to motor vehicle insurance. Fraudulent activity in the process of setting up claims in relation to motor vehicles makes up a significant part of the illegal conduct perpetrated towards insurance institutions in the Czech Republic and is a serious problem in the insurance markets. Frauds in motor vehicles cause insurance companies, which spend significant funds to prevent and detect this kind of infringement, considerable economic losses. Part of preventive activities of insurance companies against insurance fraud is close cooperation with the Czech police. Defense against insurance fraud is a challenging issue, at which the insurance companies put great emphasis on quality risk management, but if there has already arisen reasonable suspicion that a crime was committed, criminal justice starts to fulfill its role, since the above action is enshrined as a crime of insurance fraud in Czech law.
