The Freedom of Speech and Protection of Personal Rights in the Media

Abstract:

Tato práce je zaměřena na popis a analýzu problematiky svobody projevu a jejího případného střetu s právy na ochranu osobnosti v mediální oblasti. První část práce je věnována teoretickému pohledu na pozici, funkci a vliv médií ve společnosti, které vnímám jako základní důvody pro jejich právní regulaci. Druhá část je rozdělena na dvě podkapitoly. Ty jsou věnovány právnímu zakotvení svobody projevu a ochrany osobnostních práv. Důraz je zde kladen na relevantní aspekty těchto právních institutů vzhledem k fungování médií. Proto sem zahrnuji nejen obecné aspekty těchto institutů, ale blíže pojednávám například o problematice ochrany osob veřejně známých, právu na odpověď a dodatečné sdělení nebo právu na ochranu zdroje informací. Aktuálnost tohoto tématu spočívá dle mého názoru především v rychlém rozvoji mediální oblasti. Média mají dnes širší dosah a možnosti uplatňování svého vlivu, na což je třeba reagovat i v oblasti právní. Text je proto doplněn o úryvky z relevantní judikatury, které usnadňují jeho lepší pochopení.

Abstract:

This diploma thesis is focused on the description and analysis of the field of freedom of speech and its possible collision with a personal rights of individuals. First part of the thesis is based on the theoretical view on the position, function and effect of media in a society. These topics are, in my opinion, a basic reasons for the legal regulation of the media. Second part is divided into two subtopics which are focused on legal regulation of the freedom of spech and personal rights. My main interest lies in the connection of these two legal institutes with a media field. That is also a reason, why it contains not only a general aspects of these legal institutes, but also a paragraphs about the people of public interest, right for answer or protection of an information source. I think that this topic is very actual because of fast development of media field. Media are now capable to target more people and apply more influence which needs to be reflected also in the field of law. I do integrate a parts of judicial decision to this text for a better understanding.
