Contract Representation in the Legal Relations

Abstract:

Bachelor thesis entitled "Terms and representation in legal relations" deals with to zoom the issue of "representation" in the valid Slovak legislation and also offers a brief cross-section of the historical developments that had a significant impact on the Slovak legal system. It brings also a look for differences between the various legal standards, since a contractual represented is impossible to speak only in civil law. The first chapter is focused on the historical development of civil law in the territory of the Slovak Republic and specifically describes the various forms of representation, according to the Civil Code as well as the establishment or dissolution in accordance with statutory provisions. The second chapter analyzes the concept of "contractual representation" and on the basis Court ruling of the Supreme Court of the Slovak Republic. Also provides a brief insight into the history of cross-section of commercial law. The third chapter is about the other legal norms, which also relate to this topic. According to the processing of a given issue is the end of the this work dedicated to the findings and recommendations.

Abstract:

Bakalárska práca s názvom „Zmluvné zastúpenie v právnych vzťahoch“ sa zaoberá priblížením si problematiky pojmu „zastúpenie“ v platnej slovenskej legislatíve a taktiež ponúka krátky prierez historického vývoja, ktorý mal významný vplyv na slovenský právny systém. Prináša tiež pohľad na rozdiely, medzi jednotlivými právnymi normami, nakoľko zmluvnom zastúpení nemožno hovoriť iba v občianskom práve. Prvá kapitola je zameraná na historický vývoj občianskeho práva na území Slovenskej republiky a konkrétne popisuje jednotlivé formy zastúpenia podľa Občianskeho zákonníka ako aj jeho vznik či zánik podľa zákonných ustanovení. V druhej kapitole sa analyzuje pojem „zmluvné zastúpenie“ aj na základe judikátov Najvyššieho súdu SR. Tiež poskytuje krátky prierez históriu obchodného práva. Tretia kapitola je venovaná ostatným právnym normám, ktoré tiež súvisia s danou témou. Za základe spracovania danej problematiky je záver práce venovaný výsledkom zistení a odporúčaniam.
