General Principles of EU Law as its Specific Source

Abstract:

Tato diplomová práce se zabývá obecnými zásadami práva EU a poskytuje ucelený pohled na jejich vznik, vývoj, funkce a roli, kterou sehrávají v právu EU jako jeho specifický pramen. Důraz je kladen zejména na Soudní dvůr EU a způsob, jakým obecné zásady formuluje ve svých rozhodnutích. Úvodem práce jsou obecné právní zásady představeny z hlediska právní teorie, a následně se práce zaměřuje detailněji na obecné zásady unijního práva, přičemž postup Soudního dvora při jejich formulaci je názorně demonstrován na konkrétních případech. Cílem práce je tak zejména vymezit, v čem jsou obecné zásady specifické a co je odlišuje od „tradičních“, psaných pramenů unijního práva.

Abstract:

This diploma thesis deals with general principles of EU law and provides a comprehensive view on their genesis, development, functions, and the role they play in EU law as its specific source, with an emphasis on the Court of Justice of the EU and the way it formulates them in its decisions. General principles of law are presented from a theoretical point of view in the very beginning of the thesis. Subsequently, the focus shifts on general principles of EU law as they are being analysed in more detail, with concrete cases demonstrating the Court’s procedure in formulating them. The main aim of this thesis is to determine what makes general principles specific, and in which aspects they differ from “traditional”, written sources of EU law.
