Can the President Influence the Decision Making of the Supreme Court of the United States?

Abstract:

Nejvyšší soud USA je vrchním orgánem kontroly ústavnosti ve Spojených státech a jako takový má značný vliv na dění v americké společnosti a pro prezidenta USA je z mocenského hlediska žádoucí, aby mu byl Nejvyšší soud ideologicky co nejblíže. Cílem této práce je na základě kvantitativní, a posléze i kvalitativní analýzy rozhodnutí Nejvyššího soudu USA zjistit, zdali vůbec a pokud ano, tak nakolik a jakým způsobem může prezident Spojených států ovlivnit rozhodování a ideologické směřování Nejvyššího soudu. Práce se zaměřuje na rozhodnutí v oblasti lidských práv, která Nejvyšší soud vydal po Druhé světové válce, konkrétně pak zkoumá rozhodnutí týkající se desegregace.

Abstract:

The Supreme Court of the United States is is the highest authority in constitutional questions in the United States of America and as such has substantial influence on the American society, hence it is desirable for the President of the USA from an authoritarian point of view to have the Court ideologically close to himself. The purpose of this paper is to determine, based on both quantitative and qualitative analysis, whether and how the President has an influence on the decesion-making and ideological direction of the Supreme Court. The main focus of this paper are decisions made in the area of civil rights after the Second World War. A few desegregation cases are then examined more thoroughly.
