Financial System and its Regulation

Abstract:

Hlavním záměrem této rigorózní práce je rozbor velmi specifického systému vznikajícího v rámci ekonomického systému, a to systému finančního a jeho klíčovým aspektům právní regulace včetně dohledu nad ním. Autorka se nejdříve zaměřila na detailní rozbor základních proměnných, zejména pojmu finance a jeho návaznosti na právní regulaci se zaměřením na okruh práva finančního. Poté teprve bylo možné přistoupit k samotné deskripci finančního systému, jeho právní regulace, jednotlivých jeho segmentů a pochopitelně také veřejnoprávní regulace a dohledu. V potaz byla brána jak právní úprava v České republice, tak její provázanost s evropskou regulací a regulací na mezinárodní úrovni. Záměr práce nesměřoval k detailnímu rozboru jednotlivých prvků finančního systému, nýbrž k podání finančního systému jako kompaktně fungujícího celku z pohledu zejména finančního práva s důrazem na jeho zcela specifickou metodu právní regulace.

Abstract:

The main point of this thesis is to analyze the financial system, the specific system arising in the framework of economic system, and to focus on the key aspects of financial system legal regulation and its supervision. In the beginnings the author pointed her attention to the detailed analysis of basic variable, mainly to the definition of the term finance and its attachment to the legal regulation with the focus on the financial law. Later on I was able to describe the financial system, its legal regulation, its segments and its supervision. The emphasis was mainly put on the Czech legal regulation and its connections to the European regulation, as well. The intentions of the thesis shouldn´t have lead to the detailed analysis of individual aspect of the financial system, but to the compact observation of the system from the point of financial law with the emphasis to its specific method of the legal regulation.
