Teacher's liability for student's acts

Abstract:

Tato diplomová práce se zabývá odpovědností učitele za jednání žáků a studentů. Práce se věnuje pojmu odpovědnost, zejména v právním pojetí. Práce definuje, v jakých situacích se učitel může setkat s civilněprávní, trestněprávní a správněprávní odpovědností. Práce identifikuje a analyzuje jednotlivé zákonné a podzákonné právní předpisy, které souvisí s odpovědností učitele. Prostřednictvím rozboru judikatury českých soudů práce představuje rozhodovací praxi soudů v otázce odpovědnosti učitele. Závěrečná část práce je věnována praktickým radám, které mohou snížit pravděpodobnost odpovědnosti učitele za jednání žáků.

Abstract:

This thesis analyses the teacher's liability for students' acts. Furthermore, the thesis explores the concept of responsibility, primarily in legal terms. The thesis defines situations in which a teacher may face civil, criminal, and administrative liabilities. This thesis identifies and analyses various statutory and sub-statutory legal provisions that are related to teachers' liability. Moreover, by analysing the case law of Czech courts, this thesis presents the decision-making practice of the courts on the issue of teacher liability. The final part of the thesis addresses practical advices that can reduce the likelihood of teacher liability for the students' acts.
