Legal Regulation of Direct State Funding of Political Parties in the Czech Republic

Abstract:

Parlamentní politické strany v rámci legislativního procesu rozhodují o vlastní finanční regulaci, což může vést k projevům neochoty ke zpřísnění podmínek, nebo dokonce ke snaze o zákonnou aprobaci deformace politické soutěže v jejich prospěch. V práci jsou jednotlivé legislativní návrhy vztahující se k regulaci přímého státního financování politických stran podrobeny kritické analýze, která zkoumá, zda tyto legislativní návrhy jsou ve shodě s dodržováním ústavních principů financování politických stran, případně zda politické strany při předkládání jednotlivých návrhů jednaly zcela realisticky a ve shodě s tezemi vlastními konceptu strany kartelu předkládaly návrhy, které měly zajistit jejich finanční blahobyt bez ohledu na dodržování těchto principů. V této souvislosti je pozornost soustředěna nikoliv jen na samotný výsledek legislativního procesu – tedy na přijatou právní úpravu, ale zejména na způsob jejího přijímání a na jednotlivé argumenty, které v rámci legislativního procesu od jednotlivých aktérů zazněly.

Abstract:

As part of the legislative process, parliamentary political parties decide on their own financial regulation, which may lead to unwillingness to tighten conditions, or even to seek to approve the distortions of political competition in their favor. In the thesis, individual legislative proposals related to the regulation of direct state funding of political parties are subjected to critical analysis, which examines whether these legislative proposals are in compliance with the constitutional principles of political party financing, or whether political parties acted in a realistic way in accordance with the propositions of the cartel's own concept – legislative proposals were designed to ensure their financial well-being regardless of compliance with these principles. In this context, attention is focused not only on the outcome of the legislative process itself - ie on the adopted legislation, but especially on the manner of its adoption and on the individual arguments that were heard from the individual actors in the legislative process.
