Abstract:

Tato diplomová práce se zabývá finančně-právními aspekty Garančního systému finančního trhu. V prvních šesti kapitolách je Garanční systém finančního trhu detailně popsán a rozebrán. První kapitola se zabývá nejen vznikem této instituce, ale také vznikem a vývojem Fondu pojištění vkladů, který je předchůdcem Garančního systému finančního trhu. Druhá kapitola obsahuje deskripci této instituce, především účel jejího vzniku, cíle a způsob fungování. Třetí kapitola je věnována organizační struktuře. Ve čtvrté kapitole lze nalézt soubor všech právních předpisů, které se vztahují ke Garančnímu systému finančního trhu a s tím spojené problematice. Další dvě kapitoly jsou věnovány dvoum pilířům této instituce, a to Fondu pojištění vkladů a Fondu pro řešení krize. Kromě obecného seznámení s těmito pilíři, je zde možné nalézt problematiku placení příspěvků pojištěných institucí či vyplácení náhrad. Sedmá kapitola obsahuje rozbor konkrétních situací, ve kterých Garanční systém finančního trhu již zasahoval. Kapitola se věnuje jen významnějším kauzám a největší důraz je zde kladen na angažmá této instituce při vyplacení náhrad klientům Sberbank CZ. V poslední kapitole se nachází pohled do budoucnosti, kde je nastíněné, kam by se mohla tato problematika v budoucnu posouvat.

Abstract:

This thesis deals with the financial and legal aspects of the Financial Market Guarantee System. In the first six chapters the Financial Market Guarantee System is described and discussed in detail. The first chapter deals not only with the origin of this institution, but also with the creation and development of the Deposit Insurance Fund, which is the predecessor of the Financial Market Guarantee System. The second chapter provides a description of the institution, in particular its purpose, objectives and mode of operation. The third chapter is devoted to the organisational structure. The fourth chapter contains a compilation of all the legislation relating to the Financial Market Guarantee Scheme and related issues. The next two chapters are devoted to the two pillars of the institution, namely the Deposit Insurance Fund and the Resolution Fund. In addition to a general introduction to these pillars, there are issues relating to the payment of contributions by insured institutions or the payment of compensation. Chapter 7 contains an analysis of specific situations in which the Financial Market Guarantee System has intervened. The chapter focuses only on the more important cases and the main emphasis is on the involvement of the institution in the payment of compensation to the clients of Sberbank CZ. The last chapter takes a look into the future, outlining where this issue might go in the future.
