Abstract:

Má diplomová práce hodnotí celý systém činností, který se zabývá opatřeními proti legalizaci výnosů z trestné činnosti a financování terorismu. Práce charakterizuje pohled na tento systém, zda je funkční a dotvořený a zjišťuje, jak české právní normy upravující oblast praní špinavých peněz fungují a jak jsou uplatňovány. Dále popisuje podstatu zákona o opatřeních proti praní špinavých peněz, kterou si v praxi finanční instituce přebírají a v souladu s ní také fungují. Teoretická část mé práce charakterizuje oblast praní špinavých peněz z hlediska právních norem, historie, samotného procesu a uvádí reálné příklady podezřelých obchodů a plnění oznamovací povinnosti. Praktická část popisuje konkrétní aplikaci klíčových povinností finančních institucí, stanovení přijatelnosti klientů bank a činnost Finančního analytického útvaru.

Abstract:

My diploma thesis evaluates the whole system of activities dealing with measures to prevent legalization of proceeds of crime and terrorism financing. The study describes the general view of the system, explains whether it works well and is completed, and finds out how the Czech legal rules regulating the area of money laundering work and how they are applied. The thesis further describes the nature of the act regulating measures against money laundering which financial institutions commonly follow and which they work in compliance with. The theoretical part of the thesis characterizes the area of money laundering from the point of view of legal norms, its history, and the process of money laundering itself, and it gives true examples of suspicious transactions and performance of duty to inform. The practical part of the study describes a particular application of key duties of financial institutions, assessment of bank clients acceptability, and activities of Financial Analytic Department.
