Abstract:

Tématem mé předkládané bakalářské práce je problematika podávání insolvenčních návrhů po novele zákona č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon). Ve své práci se zabývám rozsáhlými změnami, které s sebou přinesla novela insolvenčního zákona, účinná od 1. 7. 2017, a to jak v oblasti podávání insolvenčních návrhů v rámci korporátních insolvenčních řízení, tak především v oblasti insolvenčního řízení u fyzických osob, tedy zejména podávání insolvenčních návrhů spojených s návrhem na povolení oddlužení. Největší pozornost v práci věnuji tzv. velké novele, někdy též nazývané jako akreditační, tedy novele insolvenčního zákona, která byla provedena zákonem č. 64/2017 Sb., kterým se mění zákon o úpadku a způsobech jeho řešení ve znění pozdějších předpisů a některé další zákony, který nabyl platnosti dne 3. 3. 2017 a účinnosti od 1. 7. 2017. Cílem této novely byla ze strany zákonodárce, dle důvodové zprávy k návrhu zákona č. 64/2017 Sb., snaha promítnout do insolvenčního zákona požadavky insolvenčních soudů na snížení vadnosti insolvenčních návrhů. Došlo především k explicitnímu výčtu osob, oprávněných k podávání insolvenčních návrhů a návrhů na povolení oddlužení. V hlavní části práce se zabývám samotným institutem podávání insolvenčních návrhů od 1. 7. 2017, tedy od účinnosti zákona č. 64/2017 Sb., kterým byla provedena tzv. velká novelizace insolvenčního zákona. Na tuto nově zavedenou praxi je v práci pohlíženo z pohledu tří zúčastněných stran, tedy z pohledu soudu, věřitele a dlužníka. V práci také poukazuji na možné nedostatky, jejichž aplikace v praxi může v rámci insolvenčního řízení způsobit obtíže především při podávání insolvenčních návrhů spojených s návrhy na povolení oddlužení.

Abstract:

The subject of the Bachelor Thesis I am submitting is the issue of filing insolvency petitions after the amendment to the Act No. 182/2006 Sb., the Act on Bankruptcy and on Methods of Bankruptcy Solutions (the Insolvency Act). My Thesis deals with the extensive changes ensuing from the amendment to the Insolvency Act, effective from 1st July 2017, both in the field of filing insolvency petitions within the scope of corporate insolvency proceedings and, primarily, in the field of insolvency proceedings related to natural person, in particular the filing of insolvency petitions in combination with the petition to allow debt relief. I pay most attention in my Thesis to the so-called Big Amendment, sometimes also called the Accreditation Amendment, namely to the Amendment to the Insolvency Act implemented by the Act No. 64/2017 Sb. which brings changes to the Act on Bankruptcy and on Methods of Bankruptcy Solutions, as amended, and to certain other Acts, and which came into force on 3rd March 2017 and took effect on 1st July 2017. As indicated in the explanatory report to the bill No. 64/2017 Sb., the purpose of this Amendment was the lawmaker’s effort to reflect in the Insolvency Act the requirements by the Insolvency Courts to reduce faultiness in the insolvency petitions. In particular those persons were explicitly listed who are entitled to file insolvency petitions and petitions to allow debt relief. The main part of this Thesis deals with the institute itself of the filing of insolvency petitions from 1st July 2017 onwards, thus from the effective date of the Act No. 64/2017 Sb. which implemented the so-called Big Amendment to the Insolvency Act. This newly implemented practice is considered in the Thesis from the perspective of three parties involved, namely the Court, the creditor and the debtor. I also point out to possible deficiencies in my Thesis, the application of which in practice may cause difficulties within the scope of the insolvency proceedings, in particular when filing insolvency petitions in combination with the petitions to allow debt relief.
