Abstract:

Diplomová práce se zabývá tématem zákazu (rozpuštění) politické strany. V úvodní části se práce zabývá pojmem politická strana, když nabízí pohled z hlediska politologického, z hlediska judikatury a z hlediska právní úpravy a poskytuje různé definice pojmu dle těchto hledisek. V návaznosti na základní vymezení politické strany jsou rozebrány strany extremistické, radikální a antisystémové. Hlavní částí celé práce tvoří právní úprava práv a povinností a zákazu politické strany v České republice. Rozebrán je vývoj právní úpravy od počátku stranictví v Českých zemích, přes První Československou republiku, komunistický režim až po současnost. Stěžejní je část zaměřující se na současnou právní úpravu. Podrobně jsou zpracovány jednotlivé důvody pro zákaz politické strany obsažené v zákoně č. 424/1991 Sb., o sdružování v politických stranách a v politických hnutích. Závěrečná část práce se zabývá judikaturou v oblasti problematiky zákazu politických stran. Nejdříve je stručně rozebrána právní úprava v Evropské úmluvě základních lidských práv a svobod a poté jsou vytyčeny hlavní podmínky pro zákaz politické strany a další principy vyprofilované judikaturou Evropského soudu pro lidská práva. Z českých případů je podrobněji zpracována kauza Dělnické strany, která byla rozpuštěna až na základě druhého návrhu vlády České republiky.

Abstract:

The thesis deals with the dissolution of political parties. At the beginning, there is a definition of “political party” from judiciary, legal and political science point of view. In connection with the definition of “political party” there are analyzed extremist, radical and anti-system parties. The main part of the thesis consists of the regulation of rights and obligations and prohibition of political parties in the Czech Republic. There is evolution of legal regulations in Bohemia, from the First Czechoslovak Republic and communist regime until the present day. The most important part is the part dealing with the current legal regulations. In detail there are described the conditions for prohibition of political parties included in the Act of Law on Association in Political Parties and Political Movements, No. 424/1991 Coll.. The final part of the thesis concerns the practice of the courts in the field of prohibition of political parties. First, there is an analysis of the (European) Convention for the Protection of Human Rights and Fundamental Freedoms and then there is a list of the main conditions for prohibition of political parties and next principles formed by the practice of the European Court of Human Rights. The practice of the Czech courts is represented by the Labour Party Case – it was dissolved after the second proposal of the Government of the Czech Republic.
