The issue of lending works of art in the Czech Republic

Abstract:

Tato magisterská práce se zaměřuje na problematiku půjčování uměleckých děl v České republicea pokrývá všechny významné okolnosti, které půjčování děl doprovázejí. Zabývá se převážně půjčováním předmětů mezi muzei v České republice a jejím legislativním prostředím, ale zároveň řeší i půjčování uměleckých děl do zahraničí a základní problematiku tohoto činu. Práce je rozdělena do čtyř hlavních částí. První část se obsáhle věnuje uvedení čtenáře do terminologie, která je pro danou problematiku relevantní. Na vymezení základních pojmů volně navazuje představení všech informačních systémů správy sbírek, které jsou v současnosti používané a při půjčování uměleckých děl hrají nemalou roli. První část dále pojednává o definici zápůjček a výpůjček a o obecných pravidlech provázejících půjčování děl a je uzavřena podkapitolou o státních zárukách a pojištění uměleckých předmětů během procesu půjčování. Druhá část práce se věnuje široké definici muzeí a jejich současnému stavu. Dále se věnuje aspektům péče o sbírky a dalším činnostem, které jsou v muzeích běžně prováděny a doprovází celý proces půjčování uměleckého díla. Tato část zahrnuje také legislativu, která představuje ve zkrácené verzi nejpodstatnější zákony, vyhlášky a metodiky, kterými se celý proces půjčování děl řídí. Druhou část práce uzavírají kapitoly o pohybu uměleckých sbírek a o českých zajímavých mediálních kauzách týkajících se půjčování uměleckých děl. Třetí část práce se věnuje zmapování procesu půjčování uměleckých děl a důkladně se zabývá legislativnímu podmínkami, za kterých se půjčuje umělecké dílo do zahraničí. Celá práce je uzavřená kapitolou o trendech v současném umění, kdy se díla pohybují na hranách všech stylů a často se vymykají klasickým šablonám určeným k půjčování uměleckých děl a mnohdy jsou i tzv. „nepůjčitelné“. Abstract:

This master thesis focuses on the issue of art lending in the Czech Republic and covers all relevant circumstances that accompany the lending process. It deals mainly with lending of art objects between museums in the Czech Republic and the Czech legislative environment, but it also pays attention to lending works of art to institutions abroad and basic issues of this act. The thesis is divided into to four main parts. The first part deals extensively with introducing the reader to the terminology relevant to the issue. The definition of basic concepts is loosely followed by the presentation of information systems of management of the collections that are currently used, and play a significant role in loans of art works. The first part also deals with the definition of lending and borrowing and lending of the general rules surrounding the works of the subchapter and is closed on State guarantees and insurance of works of art during the lending process. The first part also deals with the definition of lending and borrowing and provides a picture of general rules valid for lending of works of art. The last part of the first part is constituted by a subchapter concentrating on State guarantees and insurance of works of art during the lending process. The second part of the thesis deals with broad definition of museums and their current status. Further, it considers aspects regarding care of collections and other activities that are carried out on regular basis in museum and accompany the whole process of borrowing a work of art. This section also includes legislation, which is an abridged version of the most important laws, regulations and methodology that rule the whole process of loans of works of art. The second part of the thesis is concluded by chapters related to circulations of art collections and to interesting Czech cases regarding loans of art objects. The third part is devoted to mapping out the process of lending works of art and thoroughly researches into legislative terms and conditions with respect to international loans. The whole work concludes with a chapter on trends in contemporary art, whose outcomes often edge various artistic styles and frequently are difficult to fit the categories for loans of works of art and can be labelled as “unborrowable“. The overall goal of the thesis is to provide a comprehensive view on loans of works of art and the operation of museums, both from legislative and theoretical perspective, and also to acquaint the reader with interesting exceptions and principles.
