The crime of murder in Czech criminal law

Abstract:

Zaměření mé diplomové práce spočívá v provedení podrobné analýzy trestného činu vraždy v českém Trestním zákoníku č. 40/2009 Sb., který je právně účinný od 1. ledna 2010. Kromě podrobného historického exkurzu o trestním právu od středověku až do novověku, jsem provedla rozbor obligatorních i fakultativních znaků skutkové podstaty vraždy, vraždy novorozeného dítěte matkou a zabití. Své dedukce jsem podpořila vložením aktuálních judikátů zejména Nejvyššího soudu České republiky a nálezů Ústavního soudu České republiky, ale i rozsudky vrchních soudů. V mé diplomové práci jsem kompletním způsobem představila úmyslný zvlášť závažný zločin vraždy a letmým způsobem jsem pojednala o nedbalostním zabití. Srovnání se slovenskou právní úpravou vydedukovalo shodné a rozdílné skutečnosti v právní úpravě. Právní úprava de lege lata je v mé diplomové práci základem, přičemž v závěru jsem podala i úvahy de lege ferenda. Aby tyto úvahy nebyly bezbřehé, soustředila jsem se na neexistující právní úpravu euthanasie v České republice, absentující trestněprávní ochranu plodu v těle těhotné matky, jež byla zavražděna a podala jsem stručný exkurz sociologických veřejných průzkumů k důvodům znovuzavedení zrušeného trestu smrti. Základním pomocným prostředkem mi samozřejmě byly samotné kodexy, jak český tak slovenský, učebnice trestního práva, odborné monografie (právní, medicínské, psychiatrické, soudně-lékařské) odborné časopisy a zejména judikatura.

Abstract:

The main aim of this master thesis is to make a detail analysis of one particular criminal offence, the murder. This crime is enacted in the Czech Act No. 40/2009 Coll., effective since 1st January 2010. Apart from the historical development of the czech criminal law between middle ages and present day, the conditions of murder as well as the murder of a newborn commited by the mother of a child and a manslaughter are analysed in the thesis. My opinions expressed in this master thesis are based on the ground of case law of the Supreme Court of the Czech Republic, the Constitutional Court and the High Court of the Czech Republic. The intentional criminal offence of murder has been fully explored within the framework of this thesis, neverthelles such crime commited by neglicence is outlined as well. Subsequently The comparison between the czech legislation and the relevant legal acts of The Slovak Republic enable us to present the differences as well as the common aspects of these two separate legal systems. The major part of my thesis is written in accordance with lex lata, except the final chapter which contains my personal opinions as is required by lex ferenda. To avoid the endlessness of speculations i have turned my attention to the legislation not yet existed in the Czech Republic. The arguments for and against the death penalty are presented in accordance with the sociological survey. The issue relating to legal protection of fetus in the body of murdered woman as well as euthanasia is the matter of long standing debates. For that reason and with regard to my personal long term study of such matter I have decided to introduce my own opinions on these criminal offences. The criminal codes of Czech and Slovak Republic are the preferable sources of information for this thesis. However the textbooks of criminal law, various monographies regarding legal, medical, psychiatric and forensic-medical view on this matter as well as the proffesional journals and in particular the case law were used for the detailed exploration of this legal issue.
