The Slave in the Roman Law

Abstract:

Předmětem této disertační práce je postižení právního postavení otroků v římském právu. Otroctví je v antických právních systémech velmi výrazným sociálně – právním fenoménem, který má značný dosah na řadu vztahů těchto společností. Jelikož se jedná o práci právního, nikoli obecně historického charakteru, téměř výhradní pozornost je věnována právním aspektům otrokova postavení v právu civilním, a to zejména obligačním. To jsou oblasti, které ponejvíce poukazují na v úvodu nastolenou tezi, že totiž římské právo chápe otroka spíše jako specifický subjekt právních vztahů, nikoli jako jejich objekt, jak zpravidla uvádí literatura.

Abstract:

The subject of this dissertation is to encompass the legal status of slaves in Roman law. The slavery is in ancient law systems very substantial social and legal phenomenon which affects many relationships in these societies. Because this thesis deals with legal rather than historical issues it concerns exclusively on law aspects of slave’s status in civil and especially obligace law. In these areas the author found the evidence to support the main hypothesis: in Roman law slave is considered to be specific subject of law relations rather than their’s object as it is usually presumed in relevant literature.
