Between Human Rights and Sovereignty - concepts of political philosophy and their application in the Reality of the Czech Republic

Abstract:

Po roce 1989 byly (v důsledku rozpadu Československa) autoritativně formulovány charakteristiky nového politického režimu v ústavním pořádku. Základní principy obsažené v Ústavě jsou přitom produkty dlouhého vývoje moderních ústavních demokracií. Proto jim lze nejlépe porozumět právě na základě genealogické perspektivy, která sleduje proces jejich utváření. Česká republika chce být ústavní demokracií, a proto je úkolem Ústavního soudu tyto principy jako základní stavební kameny našeho politického a ústavního pořádku udržet (a tím udržet i ústavní demokracii). Uvedené koncepty Ústavní soud aplikoval při řešení velkých ústavních kauz již od svého vzniku. Tato práce chce porozumět tomu, jak Ústavní soud pracuje s těmito základními koncepty, které jsou také hluboce zakořeněny v tradici politické filosofie. Nejprve je proto třeba rozumět významu těchto konceptů v tradici politické filosofii samé, protože právě v ní byly nejprecizněji formulovány. V první, metodologické části práce, je představena metoda genealogie a architektury (jako část obecného schmittovského rámce 'sociologie právních konceptů'). V obecné části práce proto nejprve zkoumám vztah demokracie a konstitucionalismu, a to jak v genealogické perspektivě, tak z hlediska současného užití těchto konceptů v judikatuře Ústavního soudu (tj. architektury). V poslední části své práce se pak zabývám koncepty suverenity a lidských práv (se zvláštním důrazem na koncepty důstojnosti, svobody a rovnosti). Užitím těchto konceptů chtěl Ústavní soud přispět k tomu, aby se Česká republika vrátila do rodiny vyspělých ústavních demokracií.

Abstract:

As a result of the fall of the communist regime (and the dissolution of Czechoslovakia), a new framework of government was constitutionally elaborated. The basic principles contained in the Constitution are the products of long evolution of constitutional democracies. Thus, they are best to be understood through the genealogical perspective which traces the process of their formation. Since the Czech Republic aspires to be a constitutional democracy, it is the role of the Constitutional Court to maintain these principles (and therefore constitutional democracy as well) which are the edifices of our political and constitutional order. The Constitutional Court has applied these concepts since its creation when deciding so-called hard cases. The thesis therefore aims to understand how the Constitutional Court deals with these concepts which are deeply rooted in the tradition of political philosophy. First and foremost, it is necessary to understand the meaning of these concepts according to the long tradition of political philosophy, because it was exactly in the discourse of philosophers where these concepts were the most precisely elaborated. In its first, methodological part, the methods of genealogy and architecture of concepts are presented (as a part of a general Schmittian framework of 'sociology of concepts'). In the general part of the thesis, the relationship between democracy and constitutionalism is analyzed by the genealogical and architectural method. In its last part, the thesis deals specifically with the concepts of (popular) sovereignty and human rights (with the special emphasis on the concepts of dignity, liberty, and equality). By applying these concepts the Constitutional Court has been contributing to the return of the Czech Republic to family of developed constitutional democracies.
