The pardon and amnesti from the president - a relic of feudalism or correction of justice

Abstract:

Bakalářská práce je rozdělena na dvě části teoretickou a praktickou část. V teoretické části vymezuji pojem amnestie a milost, uvedu zde hlavní rozdíl mezi těmito termíny. Dále vymezím pojmy abolice, agraciace, zahlazení odsouzení. V další části se soustředím na přehled ústav od roku 1945 a je zřejmé, že každá vznikla za jiných „historických“ podmínek. V poslední části cituji čl. 62 a 63 současné ústavy, která shrnuje pravomoce prezidenta republiky. V praktické části se soustředím na současného prezidenta republiky Václava Klause a jeho předchůdce Václava Havla. Po krátkém životopise jsem si vybrala několik milostí, které udělil Václav Havel (Marta Chadimová, Jan a Josef Tancošovi a dále Andreas Leitner). U Václava Klause jsem si vybrala milost udělenou Ludmile Brožové-Polednové a Radce Kadlecové. U každého prezidenta se zabývám počtem udělených milostí. Zmiňuji i činnost spolku Šalamoun. Dotazníkem zjišťuji pohled dotazovaných, jak vnímají roli prezidenta republiky. Práce hodnotí pohled nejen můj, ale i ostatních osob na roli prezidenta a jeho pravomoce, dále se soustřeďuje na milosti, počet udělených milostí a je patrno, že tato pravomoc je vnímána velmi citlivě a dokáže vyvolat i negativní emoce. Počet milostí je diskutabilní a při srovnání prezidentů České republiky je jejich přístup velmi odlišný. Cílem této práce je odpověď na otázku, zda je třeba chápat milost jako korekci justice nebo feudální přežitek. Je možnost tuto práci vnímat jako studii, zda nás zajímá milost jako instituce. Tato pravomoc by mohla zajímat každého z nás.

Abstract:

The bachelor's thesis has been divided into two parts: theoretical and practical part. The term of amnesty and the pardon from the president have been specified in the theoretical part, and I have also introduced the main difference between these two terms. Some more terms such as abolition, aggravation, sentence obliteration have been defined in this part. My thesis focuses on the survey of Czech constitution since 1945, and it is obvious that each constitution was created under quite different historical conditions. The articles 62 and 63 of the current constitution, including the authority of the Czech president, have been quoted. The practical part focuses on the comparison of Mr. Vaclav Klaus, the current president of the Czech Republic and Mr. Vaclav Havel, the ex- president of the Czech Republic. After both brief CVs a description of some people pardoned by Vaclav Havel (Marta Chadimova, Jan and Josef Tancos, and Andreas Leitner) follows. I´ve introduced two pardons, which were made by Vaclav Klaus – Ms Ludmila Brozova-Polednova and Ms Radka Kadlecova. The thesis concentrates on the number of granted pardons which were made by both presidents. I have also mentioned the Solomon association. The views of all people interviewed and on how they perceive the role of the president have been determinated by a questionnaire. The bachelor's thesis doesn´t evaluate just my point of view on the role of the president and his authority, but it is focused on all pardons, as well as the number of the pardons, and it is clear that the authority to grant pardons has been viewed in a very sensible way and it is able to reveal negative emotion. The number of pardons seems to be controversial and the access to the pardons by Czech presidents has been comprehended in a completely different way. The aim of my thesis is to answer the question whether a pardon might be understood as a relic of feudalism or correction of justice. It is possible to understand this thesis as a study whether we are interested in pardons as an institution. This authority might be interesting for everybody.
