Law, Sexual Crime and Offender (Topical Legal and Psychological Problems)

Abstract:

This diploma thesis deals with the sexual deliquency issues, offenders of these sexual offences and the occurence of sexual criminality in the Czech Republic with focus on the chosen region, that is in my case region Juhomoravský kraj. I have divided the text of the thesis into teoretical and practical-application part. The first chapter of its theoretical part is devoted to human sexuality as a necessary part of our lives, sexual motivation and the norm of the sexual behavior especially from the point of view of the sexology and psychology. The main topic of the second chapter is the sexual behavior, sexual deviant behavior, sexual deliquencies and their typology. I strive to approach the individual sexual deliquencies and their subject matters, that are regarded as criminal in the Czech Republic, in the next, third chapter. The last chapter of the theoretical part, the fourth chapter is devoted to the characteristics of the offenders of the chosen sexual deliquencies. I bring the analysis of the personality of the sexual offender in general at first in the beginning of this chapter and then I focus on the sexual offenders of the chosen sexual offences, that are sexual abuse and rape. I try to approach the issue of the sexual deliquency in the Czech Republic and region Juhomoravsky kraj in the practical-apllication part and its fraction in the overall criminality. The foundations, that I rely on in the second part of the thesis, are the data posted on the web pages of the Police of the Czech Republic and the Ministry of the interior of the Czech Republic. The conclusion of the practical-application part approaches the evaluation of the current enactment of the sexual deliquency and suggestion of the new possibilities leading to its improvement, in fact to the considerations de lege ferenda.

Abstract:

Táto diplomová práca sa zaoberá problematikou sexuálnej delikvencie, páchateľmi týchto trestných činov a výskytom mravnostnej kriminality v Českej republike so zameraním na vybraný región, ktorým v mojom prípade je Juhomoravský kraj. Text práce som rozdelila na teoretickú a prakticko-aplikačnú časť. V prvej kapitole teoretickej časti sa venujem ľudskej sexualite ako nevyhnutnej súčasti nášho života, sexuálnej motivácii a normalite sexuálneho chovania z pohľadu psychológie a sexuológie. Nosnou témou druhej kapitoly je sexuálne chovanie, sexuálne deviantné chovanie, sexuálne deviácie a ich typológia. V ďalšej, tretej kapitole pristupujem k jednotlivým sexuálnym deliktom a ich skutkovým podstatám, ktoré sú v Českej republike posudzované ako trestné. Posledná, štvrtá kapitola teoretickej časti je venovaná samotným páchateľom vybraných sexuálnych deliktov. V úvode tejto kapitoly prinášam najskôr analýzu osobnosti páchateľov sexuálnych deliktov vo všeobecnosti a následne sa venujem páchateľom vybraných sexuálnych deliktov, konkrétne páchateľom znásilnenia a pohlavného zneužívania. V prakticko-aplikačnej časti sa zameriavam na problematiku sexuálnej delikvencie v Českej republike a v Juhomoravskom kraji a jej podiel k celkovej kriminalite. V druhej časti práce vychádzam z údajov sprístupnených na internetových stránkach Polície Českej republiky a Ministerstva vnútra Českej republiky. V závere prakticko-aplikačnej časti pristupujem k zhodnoteniu aktuálnej právnej úpravy sexuálnej delikvencie a navrhnutiu nových možností smerujúcich k jej zlepšeniu, teda k úvahám de lege ferenda.
