Debt collection

Abstract:

Tato diplomová práce pojednává o vymáhání pohledávek mezi podnikatelskými subjekty. V textu je zasazen institut pohledávky do širšího kontextu ekonomického růstu podniku a fungování společnosti jako celku. Zmíněny jsou odlišné přístupy nakládání s pohledávkami i možnosti, kterými věřitel disponuje při jejich řešení. Autor se dále zaměřuje na detailní přiblížení nástrojů mimosoudního a soudního vymáhání, které následně promítá do faktických poznatků z praxe. Zdůrazněny jsou okolnosti, kterých je třeba si při vymáhacím procesu zejména povšimnout a na které si dát z pozice věřitele zvýšený pozor. Akcentován je taktéž význam předcházení vzniku pohledávek, způsoby výběru obchodních partnerů a hledisko prevence jejich selekce. Cílem práce je komplexně definovat jednotlivé instrumenty vymáhání pohledávek, provést jejich vzájemné porovnání a zohlednit jejich klady a zápory. Praktická část je zakončena komparací úspěšnosti vymáhání pohledávek ve fázi mimosoudní a soudní.

Abstract:

This diploma thesis deals with the debt collection of receivables between business entities. The institute of receivables is set in a broader context of the company's operation and its economic growth. Within the text are mentioned different approaches to the management of receivables and the options available to the creditor in resolving them. The author also focuses on a detailed description of the tools of amicable and legal debt collection, which are then reflected in factual knowledge from practice. Highlighted are circumstances that need to be taken into account during the debt collection processes and that of which the creditors should be especially aware. Outlined is the importance of preventing the occurrence of receivables, the methods of choosing a business partner and aspects of their selection. The aim of the work is to comprehensively define individual instruments of debt collection, compare them with each other and take into consideration their pluses and minuses. The practical part is concluded with a comparison of the success rates of debt collection in the amicable and legal phase.
