The Influence of Emotions and Mental Disorders on Criminal Act Witness`s Credibility

Abstract:

Cílem této práce bylo ověřit, zda se v závislosti na emočním arousalu a valenci události liší druh informací, které si svědek ohledně této události zapamatuje. Dalším cílem bylo zjistit, jestli odlišný typ události a vyšší míra depresivní a úzkostné symptomatiky na straně svědka významně ovlivní jeho věrohodnost a identifikaci pachatele trestného činu. Teoretická část práce přináší souhrn dosavadních poznatků vztahujících se k vybranému tématu práce. Ve výzkumné části je prezentován výzkum, ve kterém jsme se snažili prokázat výše zmíněné. Výzkumný soubor čítal 153 participantů, rozdělených do dvou experimentálních skupin, lišících se v míře vykazování depresivních a úzkostných symptomů. Participanti prostřednictvím online formuláře zhlédli simulovaný trestný čin (negativní emoční video) a neutrální video, vyplnili Dotazník nálady a úzkostných symptomů (MASQ). Dále podstoupili výslech a svědeckou identifikaci. Prokázali jsme, že emoce přítomné během činu zvyšují specifickou věrohodnost svědecké výpovědi vztahující se k dané události. Dále se ukázalo, že svědecké výpovědi a identifikace obecně nelze považovat ze zcela přesné a úplné. Případnou psychickou zranitelnost svědka lze považovat pouze za potenciální rizikový faktor, nikoliv za prediktor nižší svědecké věrohodnosti. Práce tak přináší poznatky týkající se problematiky věrohodnosti svědecké výpovědi v závislosti na duševním stavu svědka vypovídajícího o emoční události. Tyto poznatky mohou napomoci vyšetřovatelům trestných činů při vedení výslechu svědka.

Abstract:

The purpose of this study was to determine whether the type of information that a witness remembers about an event varies depending on the emotional arousal and valency of the event. Another goal was to determine whether a different type of event, as well as a higher level of depressive and anxiety symptoms on the witness side, would have a significant impact on witness credibility and identification of a criminal offender. The theoretical section of this thesis summarizes prior knowledge related to the study's chosen topic. The research section contains a study in which we attempted to demonstrate the aforementioned. The sample included 153 participants divided into two experimental groups, based on the extent of depressive and anxiety symptoms. Via an online form, the participants then watched a crime record (negative video with high emotional arousal) and neutral video, then filled in the Mood and Anxiety Symptom Questionnaire (MASQ). They then underwent an interrogation and identification of the criminal offender. We demonstrated that the presence of emotions during a criminal act increases the specific credibility of a witness testimony related to that event. Furthermore, we discovered that witness testimony and identifications in general are not accurate and complete. A witness's psychological vulnerability can only be regarded as a potential risk factor, not as a predictor of lower witness credibility. This study presents findings from the field of witness credibility as it relates to the psychological state of the witness testifying about an emotional event. These findings can aid criminal investigators in the interrogation of witnesses.
