Judicial Power and its Role in the Society

Abstract:

Následující text bakalářské práce popisuje vývoj českého právního systému a jeho vlivu na společnost v kontextu se společensky přijímanými zásadami mravnosti a etiky s cílem dosažení obecné spravedlnosti v celém systému práva. Právo a spravedlnost ve světle základních zásad a principů spravedlnosti byly a jsou významně ovlivňovány výkonem moci soudní. Soudní moc v České republice je nezávislá a není tedy ze své činnosti odpovědna žádné jiné moci, ať již zákonodárné nebo výkonné. Soudní systém z pozice nezávislé státní instituce poskytuje výklad právním normám s cílem dosáhnout spravedlnosti a rovnováhy v právu. Záruky spravedlnosti při aplikaci práva jsou v demokratické společnosti zpravidla zakotveny již v samotné Ústavě. Jednak tím, že základní práva a svobody jsou pod ochranou soudní moci a rovněž skutečností, že sama soudní moc je vykonávána nezávislými soudy. Nezávislost výkonu soudcovské funkce a nestrannost soudců nesmí nikdo ohrožovat, ani do jejich činnosti zasahovat. To je také důvod, proč soudce nemůže být zároveň poslancem či senátorem, nesmí být činný ve veřejné správě ani vykonávat řadu jiných činností stanovených zákonem (např. podnikat).

Abstract:

The following thesis describes the development of the Czech legal system and its impact on society in the context of the socially accepted principles of morality and ethics in order to achieve general fairness throughout the justice system. Law and justice in light of the fundamental principles and principles of justice were and are greatly affected by the exercise of judicial power. Judicial power in the Czech Republic is independent and it is not responsible for its activities to any other authority, whether legislative or executive. The judicial system in its positions of an independent state institution provides interpretation of legal norms in order to achieve fairness and balance in the law. Guarantees of fairness in application of the law in a democratic society are usually enshrined in the Constitution itself. Firstly the fundamental rights and freedoms are protected by the judiciary and also with the fact, that the very judicial power is exercised by independent courts. The independence of execution of judicial duty and the impartiality of judges must not endanger anyone or interfere in their activities. That is why the judge can not be simultaneously a representative or senator, can not be employed in public administration, or perform many other activities stipulated by law (eg to run a business).
