Disciplinary Proceedings at Higher Education Institution - Sufficient Ensuring of the Right to a Fair Trial?

Abstract:

Bakalářská práce „Disciplinární řízení na vysoké škole – dostatečné zabezpečení práva na spravedlivý proces?“ podává ucelený pohled na projevy spravedlivého procesu v disciplinárním řízení v porovnání těchto projevů v trestním řízení. V práci je v první řadě charakterizována vysoká škola, dále jsou zde popsány její orgány, její vnitřní předpisy a disciplinární přestupek. Následuje charakteristika samotného práva na spravedlivý proces, charakteristika správního a soudního trestání. Hlavní část tvoří popis celého trestního a disciplinárního řízení od subjektů, přes zahájení řízení až po vydání rozhodnutí a udělení sankce, s analyzováním projevů práva na spravedlivý proces a jejich zakotvení v ústavním pořádku a příslušných zákonech. Následně jsou informace využity v empirickém výzkumu, který obsahuje analýzu dokumentů – zápisů z disciplinárních řízení – z pohledu projevů spravedlivého procesu. V závěru práce jsou všechny poznatky shrnuty a vyhodnoceny problémové oblasti v zakotvení práva na spravedlivý proces v aktuální právní úpravě disciplinárního řízení. Cílem bakalářské práce „Disciplinární řízení na vysoké škole - dostatečné zabezpečení práva na spravedlivý proces?“ je pomocí odborné literatury, příslušné judikatury a zákonů porovnat a zhodnotit průběh disciplinárního řízení a trestního řízení, zhodnotit záruky studenta na spravedlivý proces a odpovědět tak na otázku uvedenou v názvu práce.

Abstract:

Bachelor thesis "Disciplinary Proceedings at Higher Education Institution - Sufficient Ensuring of the Right to a Fair Trial?" gives a comprehensive view of exhibits of a fair trial in the disciplinary process in comparison with these exhibits in criminal proceedings. The beginning of the thesis characterizes college. It also describes its institutions, its internal regulations, and its disciplinary offense. Next it shows the characteristics of the right to a fair trial along with characteristics of administrative and judicial punishment. The main part consists of a description of the whole criminal and disciplinary proceedings of entities, from an initiation to an issued decision and granting of sanctions, also analyzing the speeches of the right to a fair trial enshrined in the Constitution and relevant laws. Subsequently, information is used in empirical research that contains an analysis of documents - records of the disciplinary proceedings – in the views of a fair trial. In the end of the thesis, all findings are summarized and problem areas are evaluated in the base of the law of a fair trial in the current legislation of the disciplinary proceedings. The aim of the thesis: "Disciplinary Proceedings at Higher Education Institution - Sufficient Ensuring of the Right to a Fair Trial?” with help of the technical literature, relevant judicature and laws, is to compare and evaluate the course of the disciplinary proceedings and criminal proceedings, and to evaluate the guarantees for a student to a fair trial and answer to the question in the title work.
