Abstract:

Tato diplomová práce nese název „Polo-prezidentské režimy (případové studie)“. Jedná se o téma aktuální a diskutované neboť v České republice je od roku 2013 volen prezident v přímých volbách. A právě přímá volba prezidenta bývá označována jako jeden ze znaků charakterizující polo-prezidentský systém. Je totiž otázkou zda Českou republiku můžeme označit za polo-prezidentský stát. A právě na tuto otázku se práce snaží nalézt odpověď. První část práce objasňuje samotný pojem „polo-prezidentský systém“ a politologické teorie s ním související. Následující část je věnována francouzskému politickému systému, jakožto vzorovému příkladu polo-prezidentského režimu. Právě ve Francii je nejvíce patrná duální struktura autority – prezident sdílí exekutivní moc s premiérem. Druhá, obsáhlejší část je zaměřena na vybrané země střední a východní Evropy (Rakousko, Polsko, Slovensko), které spojuje především jeden charakteristický rys a tím je přímo volený prezident. Práce se snaží o porovnání postavení prezidentů v těchto zemích. Jednotlivé ústavy, vybraných států, je definují jako parlamentní republiky, avšak prezidenti jsou zde voleni přímo. A přímá volba dává prezidentovi vyšší legitimitu odvislou od občanů. S příchodem silné osobnosti do funkce prezidenta, který by se aktivněji vměšoval do vládní politiky, by mohlo postupem času dojít k posunu od parlamentarismu k semipresidencialismu. Poslední část je věnována České republice, jejímu historickému vývoji, zejména pak politickému vývoji po roce 1989. Práce, na konkrétních příkladech, popisuje a analyzuje jednání nově zvoleného prezidenta Miloše Zemana. Například jeho počínání při jmenování nových velvyslanců a fakt že prosadil svoji kandidátku L. Klausovou. Jedná nový prezident v rozporu s ústavou? Cílem této práce bylo objasnit a definovat pojem polo-prezidentský systém, a zda Česká republika k tomuto systému směřuje.

Abstract:

This thesis is called „Semi-presidential regimes (case studies)“. This issue is very current and discussed in The Czech Republic because the president has been elected in a direct election here since 2013. The direct election is one of the features characterizing the semi-presidential regime.There is a question if we can describe the Czech Republic as a semi-presidential country? The thesis seeks to answer this question. The first part of thesis clarifies the concept of a semi-presidential regime and the political science theories related. The following section is about the French political system, because this system is a prototype of the semi-presidential regime. In France, the most obvious is the dual structure of an autority – the president shares the executive power with the prime minister. The second more extensive part focuses on the countries of central and eastern Europe (Austria, Poland, Slovakia). These countries have one common feature – directly elected president. This thesis tries to compare a position of the president in these countries. These countries are defined as parliamentary republics but the presidents are elected directly. The direct election of the president gives him/her a greater legitimacy derived from and given by citizens. With an arrival of the president with a very strong personality, who would actively interfere in government policy, a shift could occur over time from the parliamentary to the semi-presidential system. The final part of the paper deals with the Czech Republic and its historical development with a paricular focus on political development after 1989. The thesis describes and analyzes acting of the newly elected Czech president in specific cases. For example his acting during the appointment of new ambassadors and the fact that he enforced his own candidate, L. Klausová. Is this acting of the president against the Constitution? The aim of this thesis was to clarify and define the concept of a semi-presidential system. It was also to discuss whether the Czech Republic leads to the semi-presidential system
