Assessment of eyewitness testimony accuracy: Effect of different type of instructions on delivering guilty or not guilty verdicts

Abstract:

Chybné identifikování očitým svědkem přispělo ke stovkám nespravedlivých odsouzení. Za účelem snížení chybovosti očitých svědků a ochrany obžalovaných před chybným odsouzením, právo stanovilo různá ochranná opatření. Tato tradiční ochranná opatření však nejsou účinná při napomáhání členům poroty kriticky vyhodnotit očité svědectví. Nejvyšší soud v New Jersey nedávno vydal nový druh soudních instrukcí, aby členy poroty poučil ohledně problematiky přesnosti identifikace učiněné očitým svědkem. Výzkum však naznačuje, že tyto instrukce jsou neúčinné při zvyšování citlivosti porotců k očitému svědectví. Naproti tomu, výzkum zabývající se jinou nedávno vyvinutou metodou (I-I-Eye) ukázal, že je možné zvýšit citlivost porotců ke kvalitě policejních procedur týkajících se práce s očitým svědkem. Účelem této studie bylo otestovat vliv těchto dvou instrukcí na rozhodnutí porotců o vině souzeného v případech, kde se liší pouze užité policejní postupy. 120 participantů přečetlo přepis trestního řízení a vyneslo výrok. Podobně jako v předchozích výzkumech, Henderson instructions neměly žádný vliv na verdikt porotců, zatímco vzdělávací pomůcka I-I-Eye zvýšila citlivost porotců ke kvalitě policejních postupů použitých při výslechu očitého svědka a následné rekognici v porovnání s kontrolní skupinou. Společně vzato, výsledky poukazují na nadřazenost pomůcky I-I-Eye nad Henderson instructions ve snaze zvýšit citlivost porotců k identifikacím učiněných očitými svědky.

Abstract:

Mistaken eyewitness identifications contributed to hundreds of wrongful convictions. To minimize the eyewitness error and to protect defendants from erroneous conviction, the law incorporated various safeguards. However, these traditional safeguards are not efficient in helping jurors to critically evaluate eyewitness evidence. Recently, the New Jersey Supreme Court issued a new set of case-specific judicial instructions to educate jurors on the issue of eyewitness identification accuracy. However, research suggests that these instructions are also ineffective in sensitizing jurors to eyewitness evidence. In contrast, research on another recently developed method (I-I-Eye) using a brief, general, educational aid showed that it is possible to sensitize mock jurors to the quality of police eyewitness procedures. The current study sought to test the effect of both these instructions on jurors’ verdicts in a case where only police procedures are manipulated. 120 participants read a trial transcript and rendered a verdict. In line with previous research, Henderson instructions did not have any effect on verdicts, while the I-I-Eye teaching aid sensitized mock jurors to the quality of interview and identification conditions as compared to no-eyewitness-instruction control condition. Taken together, results indicate superiority of the I-I-Eye aid to Henderson instructions in sensitizing jurors to eyewitness identification evidence.
