Protection against inaction of the administrative bodies.

Abstract:

„Ochrana pred nečinnosťou pri poskytovaní informácii“ Slobodný prístup k informáciám je dôležitým princípom demokratickej spoločnosti. Momentálne máme prístup k informáciám upravený hlavne v dvoch zákonoch – všeobecná úprava o prístupe k informáciám (zákon č. 106/1999 Sb., o slobodnom prístupe k informáciám) a zvláštny zákon o prístupe k informáciám o životnom prostredí (zákon č. 123/1998 Sb., o právu na informácie o životnom prostredí). Obidva tieto zákonu stanovujú slobodný, otvorený prístup k informáciám na základe princípu publicity. Zaujímavou otázkou ale zostáva, čo má jednotlivec robiť, ak informácie aj napriek podanej žiadosti nedostane. Táto práca chce nájsť odpoveď práve na túto položenú otázku. Jej prvá časť sa zaoberá kontrolou žiadosti o informácie, aby sme mohli overiť našu hypotézu, že sa jedná o kvalifikovanú protiprávnu nečinnosť. V druhej časti sa už následne zaoberám konkrétnymi prostriekami, ktorými sa môžeme proti takejto nečinnosti brániť. Jedná sa hlavne inštitúty: 1. sťažnosti podľa § 16a InfZ/odvolanie proti fiktívnemu negatívnemu rozhodnutiu (§9, odst. 3 InfŽPZ); 2. Obrana proti nečinnosti podľa § 80 SŘ; 3. Súdna ochrana pred nečinnosťou (v systéme správneho súdnictva, ústavná sťažnosť a ďalšie možnosti medzinárodnej súdnej ochrany); 4. Verejný ochranca práv; 5. Právna zodpovednosť; 6. Sťažnosť podľa § 175 SŘ. Cieľom tejto časti (a tejto práce vo všeobecnosti) je poskytnúť žiadateľovi aspoň základné informácie o opravných prostriedkoch, ktoré môže pri nezákonnej nečinnosti pri poskytovaní informácii použiť, aby sa prístup k nformáciám naozaj otvoril. A na úplný záver som zaradila kapitolu s návrhami de lege ferenda, v ktorej som sa snažila v skratke načrtnúť hlavné problematické body, ktoré som na zmienených zákonoch postrehla.

Abstract:

This thesis is dealing with a following topic: “Protection against the inactivity in providing information in Czech law“. Free access to information is an important principle of democratic society. Nowadays, the access to information is set in two main acts - the Act No. 106/1999 Coll. on Free Access to Information and the Act No. 123/1998 on the Right to Information about the Environment. Both these Acts establish the free access to information, but there is still one interesting question persistent – what shall we do, if we do not receive the information (even if we have made a required and correct application) and the respective authority fails to act in accordance to the law, or more precisely, fails to act at all. This thesis is dealing exactly with this question of inactivity of the authority requested for information. In the first part of this thesis, I am focusing on the controlling of the information application - which conditions have to be fulfilled to verify the hypothesis of illegal inactivity. In the second part, I attempted to outline the main possibilities and tools of protection against the inactivity in providing information. I have divided this part into chapters dealing with particular legal remedies: 1. Complaint against a violation of Information Act (§ 16a Act No. 106/1999 Coll. on free access to information) / appeal against a fictitious decision about denial of information (§9, clause 3 Act No. 123/1998 on right to information about the environment); 2. Defense against the inactivity under the § 80 Act No. 500/2004 Coll., Rules of Administrative Procedure; 3. Judicial protection against the inactivity (in the system of administrative judiciary, constitutional court and other possibilities of international judicial protection); 4. The institution of ombudsman; 5. Legal responsibility; 6. Complaint pursuant to the § 175 Act No. 500/2004 Coll., Rules of Administrative Procedure. The aim of this part (and of my thesis in general) is to offer instruction for how to use our right to apply for remedial measure in case of illegal inactivity in providing information. And finally, there is a chapter dealing with the reflections of “de lege ferenda” proposals. It is merely a modest summary of the most critical points of these acts.
