Imports of goods in the Czech Republic prior and after entering EU, carrying controls after releasing of goods

Abstract:

Práce je věnována problematice dovozu zboží před a po vstupu ČR do EU (období r. 2000 - 2005), se zaměřením na počty uskutečněných dovozů, podíl jednotlivých regionů na dovozech (EU a třetí země), vývoj příjmů cla, způsob zaúčtování celního dluhu …Je zřejmý pokles výběru cel a tím i pokles fiskálního přínosu do státního rozpočtu, z důvodu vstupu do EU, jeho příčiny ( volný obchod v rámci EU, odvody ve výši 75 % do rozpočtu EU). Stěžejní část práce je věnována následným kontrolám po propuštění zboží. Tzn.: legislativní úprava, smysl, účel, příprava, zahájení kontroly, postup, dokumentace,až po doměření celního dluhu, včetně případného postihu (přestupek,delikt). V závěru práce je upozorněno na určité problémy, které jsou v oblasti provádění následných kontrol, ať již v souvislosti s interní, úpravou nebo v souvislosti se vstupem do EU ( nefunkčnost evidencí, nedostupnost dat apod).

Abstract:

Subject of my thesis is import of goods before and after accession of the Czech Republic to the European Union and executing of ex post controls after release of goods, which is closely related to import of goods.Introduction of the thesis is aimed to chart situation in the area of import, comparison of total amounts of import before and after the accession to the EU, comparison of import from the point of view of countries of trade, presentation of impact of the accession to the amount of released goods, especially amount of finance collected by the Czech Customs Administration.The next, main part, of my thesis is devoted to problems of ex post controls. My objective is to provide global picture of the ex post controls. I aimed my effort to introduce the ex post controls from the view of their practical realization. It means description of ex post controls in single steps, from the preparation for controls, building the team, the very opening of control, choosing the place of control, individual control operations, control records, to the payment order and possible solution of customs regulation infringement. Briefly I mention file agenda and accounting of imposed customs duty. In the end of the thesis I pursued some imperfections and application problems I meet in practice. I also try to outline some possible solutions of those problems and imperfections. I divided them to imperfections in internal arrangements, oriented to territorial competence, and the way of imposing of customs duty in the frame of ex post controls. Marginally I try to point out problems connected with application of controls at people who are seated in the Czech Republic but release the goods in other member states. In the last part of the thesis I deal with problem in the area of ex post controls from the EU point of view.
