Abstract:

Tématem zvolené diplomové práce jsou základy trestní odpovědnosti a správně právní odpovědnosti za přestupek, tedy oblast trestního práva hmotného a správního práva hmotného. Zvolené téma je o to zajímavější, že trestní právo hmotné se s účinností od 01.01.2010 dočkalo rekodifikace po téměř padesáti letech a po více jak dvaceti letech od pádu komunistického režimu v České republice. V diplomové práce je učiněn i historický exkurs do základu trestní odpovědnosti a správně právní odpovědnosti za přestupek. Cílem této diplomové práce není podrobně rozebrat problematiku trestního práva hmotného či správního práva hmotného, ale spíše poukázat na základy těchto odpovědností, tak jak jsou zakotveny v českém právním řádu; poukázat na praktické dopady a přiblížit někdy i „odlehčenou“ formou problematiku laické veřejnosti. Dále je snahou přinést čtenáři základní orientaci v základech trestní odpovědnosti včetně trestních sankcí a základech správně právní odpovědnosti za přestupek včetně správních sankcí. Současně je snahou poukázat i na základní diference mezi oběma systémy.

Abstract:

Criminal law and administration law has a very important meaning in a society. Everybody is in a direct or in an indirect way effected by both of them. The main topic of this thesis is the basis of criminal responsibility and the legal liability of the violation which is in relation with the substantive law of crime and the substantive law of administration. This topic is much more interesting due to the recodification with efficiency from the 1st of Janury of 2010. It means that it is new after almost fifty years period and finaly it is here after more than twenty years period when the communism was terminated in the Czech Republic. There is an historical excursus to the criminal liability basis and to the legal liability bases for the violation in this thesis. Goal of this thesis is not to describe in a detail the questions of the substantive law of crime and the substantive law of administration but to refert to the basis of these liabilities in a way how they are set in the Czech legal order; refer to practical influence and approach the „lighten“ way of these questions to the laical public. The other goal is to give the basic principle of criminal liability including the punitive sanction and the legal liability of the violation including the legal sanction to the public. Simultaneously, there is an effort to point the fundamental difference betwen both of the system.
