House search as an act of criminal proceedings within drug crime

Abstract:

Tato diplomová práce je zaměřena na problematiku domovní prohlídky a prohlídky jiných prostor a pozemků v rámci drogové trestné činnosti. Cílem diplomové práce je čtenáři uceleně představit specifika plánování, ale zejména výkonu prohlídek v této problematice a to jak z právního, tak i kriminalistického pohledu. Zaměřením se práce dotýká výkonu prohlídek v prostorech, kde dochází k výrobě látky pervitin nebo k pěstování rostlin netechnického konopí. V kapitolách teoretické části práce je kladen důraz na nutnost správné volby požadovaného institutu prohlídky ve vztahu k objektu zájmu a význam řádného odůvodnění neodkladnosti a neopakovatelnosti úkonu, pokud mají být prohlídky provedeny před zahájením trestního stíhání. V dalších kapitolách práce pojednává o zajišťování věcí důležitých pro trestní řízení z pohledu dané problematiky a to včetně rozhodování o těchto věcech v průběhu trestního řízení. Dále jsou uvedeny osoby, které se mohou prohlídek zúčastnit a je šířeji rozvedena nezastupitelná úloha experta – znalce z oboru kriminalistiky. V praktické části je uveden popis plánování a výkonu prohlídky v objektu indoor pěstírny konopí.

Abstract:

This diploma thesis is focused on the issue of house searches and searches of other premises and land within drug crime. The aim of the thesis is to comprehensively introduce the specifics of planning, but especially the performance of searches in this area, both from a legal and forensic point of view. The thesis is focused on the performance of searches in premises where methamphetamine is produced or where non-technical cannabis is grown. The chapters of the theoretical part emphasize the need for the correct choice of the required search institute in relation to the object of interest, the importance of proper justification of urgency and non-repeatability of the act if searches are to be carried out before criminal proceedings. In the next chapters, the thesis deals with securing things and objects important for criminal proceedings from the point of view of the given issue, including decisions about these things and objects during criminal proceedings. Furthermore, there is a list of persons who can take part in the searches, and an explanation of the irreplaceable role of a forensic expert – expert in the field of criminology. The practical part describes the planning and execution of a search in a cannabis growing room.
