Selected Legal Aspects of Text and Data Mining

Abstract:

Diplomová práce se zabývá aktuálním přístupem autorského práva k vytěžování textů a dat. Cílem práce je nalezení odpovědi na otázku, zda při vytěžování textů a dat dochází k užití předmětu ochrany. Práce nejdříve popisuje technickou realitu a právní kvalifikaci vytěžování textů a dat, následně provádí kritickou analýzu úpravy exkluzivních práv, a nakonec kriticky diskutuje možný zásah do exkluzivních práv. Práce dochází k závěrům, že při vytěžování textů a dat nedochází k užití předmětu ochrany, jelikož by takové užití bylo v rozporu s principem idea-expression dichotomy, a proto jsou v závěru práce představeny úvahy de lege ferenda.

Abstract:

This thesis deals with the current attitude of copyright law towards text and data mining. The thesis aims to find an answer to the question of whether a subject matter of copyright is being used during text and data mining. Firstly, the thesis describes the technical reality and legal qualification of text and data mining. Secondly, the thesis carries out a critical analysis of the legislation regarding exclusive rights. Lastly, the thesis critically discusses the possible interference with exclusive rights. The thesis concludes that the subject matter of copyright is not being used during text and data mining because such use was contrary to the principle of idea-expression dichotomy. De lege ferenda considerations are presented at the end of the thesis.
