Directive 93/13/EEC and its Implementation into the Czech Private Law (Consumer Protection)

Abstract:

V rámci spotřebitelského práva se zaměřuji na nekalá ujednání ve spotřebitelských smlouvách, která se objevila v našem právním řádu v souvislosti s implementací Směrnice Rady 93/13/EHS ze dne 5. dubna 1993 o nepřiměřených podmínkách ve spotřebitelských smlouvách. Tato směrnice zaručuje minimální standard ochrany spotřebitele před nekalými ujednáními ve spotřebitelských smlouvách ve všech členských státech ES. ES se tím snaží ochránit jednotný vnitřní trh, před deformacemi hospodářské soutěže. Implementace této směrnice neproběhla v ČR bez problémů. Vykazuje četné nepřesnosti a chyby, které jsou způsobeny jak špatným překladem směrnice do českého jazyka, tak i nezkušeností ČR, jakožto poměrně mladého člena ES, s problematikou implementace směrnic. Přes všechny problematické body se Směrnicí 93/13/EHS spojené, však přinesla do našeho právního řádu značný prvek právní jistoty, a to jak pro spotřebitele, tak pro dodavatele. Zavedla nové, našemu právnímu řádu doposud neznámé, instituty jako například institut spotřebitelských smluv. Zavedla také novou kategorii ujednání, která jsou zakázaná a neměla by se ve spotřebitelských smlouvách vyskytovat.

Abstract:

I focus on unfair terms in consumer contracts within the consumer law that have appeared in our system of law in connection with the implementation of the Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts. This directive guarantees the minimum standard of the consumer protection against the unfair terms in consumer contracts throughout all EC member states. The EC thus tries to protect the unified internal market from deformations of economic competition. In the CR, the implementation of this directive has not been effected without problems. There has been a range of inaccuracies and mistakes caused either by wrong translation into the Czech language or by the inexperience of the CR, as a relatively young EC member, with the questions of the directives implementation. However problematic some points in the Directive 93/13/EEC were, it has brought a considerable element of the legal peace for both consumer and supplier into our system of law. It has introduced new, for our system until that time unknown, institutes as for example consumer contracts institute. It has also introduced the new category of those terms that are prohibited and shall not appear in consumer contracts.
