Effet Utile Principle in the Case Law of the Court of Justice

Anotace:

Ve své práci se věnuji specifické zásadě ovládající do značné míry výklad prováděný Soudním dvorem Evropské unie, jejíž důsledky měly a mají velký vliv na celkový charakter unijního práva. Diplomová práce se věnuje definování pojmu effet utile, jeho projevům v unijním právu, vnitrostátním projevům effet utile a dotváření práva. Cílem práce je zevrubně komplexně shrnout problematiku této zásady a přiblížit její význam a dopady čtenáři se zaměřením na studenty právnických fakult. Autorka práce čerpala zejména z rozhodnutí Soudního dvora, odborné literatury a primárních pramenů unijního práva.

Abstract:

In my thesis I focus on a specific principle that influences largely the interpretation of the Court of Justice of the European Union and whose consequences have had a big effect on the general character of the EU law. This thesis explores the definition the term „effet utile“, its manifestation in the EU law, the intrastate manifestation of effet utile and the co-creating of law. The objective of this thesis is to summarize the issue of this principle thoroughly and comprehensively and to explain its significance and impacts to the readers with focus on law school students. The author of this thesis based it especially on the decisions of the the Court of Justice of the European Union, the specialized literature and the primary sources of the EU law.
